8 <br />TW185\1\1011577.v13 <br />1) this Agreement has been fully executed by both parties and <br />recorded in the Office of the Ramsey County Recorder <br />and/or Registrar, <br />2) The Security has been received by the JDA to the extent set <br />forth in Section 33 below, <br />3) The Final Plat and this Agreement have been recorded in the <br />Office of the Ramsey County Recorder and/or Registrar, as <br />applicable, within sixty (60) days of JDA approval, failure <br />to do so will void the plat approval. <br />4. COMMENCEMENT AND COMPLETION OF DEVELOPMENT. The <br />Developer shall obtain a building permit from the City within one year of recording this Agreement <br />and commence construction on the Subject Property within six (6) months after issuance of the <br />building permit. The Developer shall substantially complete construction on the Subject Property <br />within twenty-four months after issuance of the building permit. <br />5. PHASED DEVELOPMENT [INTENTIONALLY DELETED] <br />6. PRELIMINARY PLAT STATUS. [INTENTIONALLY DELETED]. <br />7. CHANGES IN OFFICIAL CONTROLS. For the period beginning on the date <br />of this Agreement, and continuing for two (2) years after that date, no amendments to the TRC, <br />the City’s Comprehensive Plan, or other JDA, City, or County codes, ordinances, regulations, <br />requirements or other official controls (the “JDA Official Controls”) shall apply to or affect the <br />use, development density, lot size, lot layout or dedications of the approved final plat or approved <br />development unless required by state or federal law or agreed to in writing by the JDA and the <br />Developer.
