9 <br />TW185\1\1011577.v13 <br />extent permitted by state law, the JDA may require compliance with any amendments to the JDA <br />Official Controls platting or dedication requirements enacted after the date of this Agreement with <br />respect to property which did not receive final plat or development approval less than two (2) years <br />prior to any such amendments. <br />8. DEVELOPMENT PLANS. The Subject Property shall be developed in <br />accordance with the plans for the Subject Property, including the architectural plans, lighting plans, <br />and landscape plans, and in accordance with the Civil Plans for the Project Site (as reviewed and <br />approved on March 17, 2025, by the JDA, with such amendments as may be approved by the JDA <br />Engineer or the JDA Development Director collectively, the “Plans”). The Plans shall not be <br />attached to this Agreement. The Plans may be prepared, subject to City approval, after entering <br />this Agreement, but before commencement of any work on the Subject Property or the Thumb <br />Parcel. If the Plans vary from the written terms of this Agreement, the Plans shall control. <br />9. INFRASTRUCTURE IMPROVEMENTS. The Developer shall install and pay <br />for the following public and private Infrastructure Improvements as required to be built within the <br />Project in accordance with the Plans: <br />A. Sanitary Sewer System (private) <br />B. Water System (public and private)(Exhibit B) <br />C. Parking Lot (private) <br />D. Driveway (public) <br />E. Concrete Curb and gutter (private) <br />F. Site Grading, Ponding, and Erosion Control (private) <br />G. Landscaping (private) <br />H. Surveying and Staking (public and private) <br />I. Setting of Iron Monuments <br /> <br />The Infrastructure Improvements shall be installed in accordance with the City Code.
