10 <br />TW185\1\1011577.v13 <br />competent registered professional engineer to the JDA for approval by the engineer designated by <br />the JDA (the “JDA Engineer”), which approval shall be provided on the condition that such <br />submittals comply with the Plans and this Agreement. The Developer shall instruct its engineer to <br />provide adequate field inspection personnel to assure an acceptable level of quality control. In <br />addition, the JDA may, at the JDA’s sole discretion and at the Developer’s sole expense, have one <br />or more construction observes and a geotechnical engineer (the “JDA Inspectors”) inspect the <br />grading (site grading and stormwater pond) and utilities (sanitary and storm sewer) as the JDA <br />may reasonably determine. The JDA will have a full-time inspector on site, during construction of <br />the Water System Improvements, at Developer’s sole expense. If as a result of such inspection, the <br />JDA Inspector reasonably determines that the Developer has failed to comply with the approved <br />Plans, the JDA shall instruct the Developer as to the nature of the non-compliance and the <br />necessary steps to achieve compliance. The Developer, its contractors and subcontractors, shall <br />follow all instructions received from the JDA Inspectors. The Developer or Developer’s engineer <br />shall provide for on-site project management. The Developer or Developer’s engineer is <br />responsible for design changes and contract administration between the Developer and the <br />Developer’s contractor. The Developer or Developer’s engineer shall schedule a pre-construction <br />meeting at a mutually agreeable time and location with all parties concerned, including the JDA, <br />City and County staff to review the program for the construction work. As required by Arden <br />Hills City Code Section 1140.04, Subd.2, the Developer shall furnish Security in an amount equal <br />to 125% of the cost of the Infrastructure Improvements as estimated by the JDA Engineer. . The <br />Developer shall provide the City with an “as constructed” plan certified by a registered land <br />surveyor or engineer that confirms the final construction of the Infrastructure Improvements.
