12 <br />TW185\1\1011577.v13 <br /> The Stormwater System Improvements, upon completion, must be inspected and approved <br />by the JDA Inspector. Following such approval, the Stormwater System Improvements, other than <br />those on the Subject Property, will remain the property of the County. Developer and the JDA <br />agree that the Stormwater System Improvements may be redesigned, enlarged, or relocated at the <br />time of future development of the Thumb Parcel to serve such additional development (“Future <br />Stormwater System Improvements”). Following completion of development on the Thumb Parcel, <br />the Future Stormwater System Improvements will be dedicated to the City. <br />11. WARRANTY. The Developer warrants all Infrastructure Improvements required <br />to be constructed by it pursuant to this Agreement for a period of twenty-four (24)months from the <br />date of acceptance by the City against poor material and faulty workmanship. All trees and shrubs <br />shall be warranted to be alive, of good quality, and disease free for twenty-four (24) months after <br />planting. Any replacement trees and/or shrubs shall be warranted for twenty-four (24) months <br />from the time of planting. <br />12. IRON MONUMENTS. As part of the Security, the Developer shall post a <br />$2,500.00 as security for the final placement of interior subdivision iron monuments at the corners <br />of the Subject Property. In accordance with Minnesota Statutes § 505.021 and Arden Hills City <br />Code Section 1140.01, the final placement of iron monuments for all lot corners and/or angles <br />must be completed before the applicable security is released. The Developer’s surveyor shall also <br />submit a written notice to the JDA certifying that the monuments have been installed. <br />13. PERMITS. The Developer shall obtain or require its contractors and <br />subcontractors to obtain all necessary permits, including but not limited to the following to the <br />extent required: <br />• Ramsey County for County Road Access and Work in County Rights-of- <br />Way
