14 <br />TW185\1\1011577.v13 <br />16. LICENSE. The Developer hereby grants the JDA, City, and County and their <br />respective agents, employees, officers and contractors a temporary license to enter the Subject <br />Property to the extent necessary to complete inspections in accordance with this Agreement. <br />17. EROSION CONTROL. Prior to initiating site grading, the erosion control plan <br />shall be implemented by the Developer and inspected and approved by the JDA. The JDA may <br />impose additional erosion control requirements if reasonably required. Prior to performing any <br />work, Developer must post escrow in the amount to be determined by the JDA engineer to ensure <br />proper installation, completion, maintenance, inspection, and enforcement of the Plan. All areas <br />disturbed by the excavation and backfilling operations shall be stabilized immediately when it is <br />known that construction activities will not resume for fourteen (14) days after the completion of <br />the work, weather permitting, or plan to utilize temporary cover on portions of the site that will sit <br />dormant for these periods of time whether or not final grading has been completed unless <br />authorized and approved by the JDA Engineer. Except as otherwise provided in the erosion control <br />plan, seed shall be in accordance with the City’s current seeding specification which may include <br />certified oat or annual rye seed to provide a temporary ground cover as rapidly as possible. All <br />seeded areas shall be maintained as necessary for seed retention. The parties recognize that time is <br />of the essence in controlling erosion. The City’s erosion control inspector will perform site <br />inspection on a bi-weekly basis. The Developer is responsible to have a dedicated Certified Erosion <br />Site Manager to perform all required inspections per MPCA, MS4, NPDES and Rice Creek <br />Watershed District. If the Developer does not comply with the erosion control plan and schedule <br />or supplementary instructions received from the JDA, the JDA shall provide the Developer notice <br />and a reasonable amount of time under the circumstances to cure, failing which the JDA may take <br />such action as it deems appropriate to control erosion and the frequency of inspections by the
