UNFINISHED BUSINESS -12A lt ARQEEN�HILLS MEMORANDUM DATE: May 12, 2025 TO: Honorable Mayor and City Councilmembers Jessica Jagoe, City Administrator FROM: Elena Fransen, Senior Planner SUBJECT: Planning Case #24-018 — Proposed Amendments to Approved Resolution 2025- 007 for Trident Development Council Should Consider Motions to approve, table, or deny the following: • A request to adopt Resolution 2025-040, an amended version of Resolution 2025-007 to modify the language of Conditions 28 and 29 in the Conditions of Approval based on the City Council approval of Planning Case 24-018 on January 13, 2025. Approval of a resolution amending conditions of a Master PUD requires an affirmative vote of four councilmembers. Background In an April 22, 2025 narrative letter to the City Council, Attachment A, Trident Development (the "Developer") proposed to make a financial contribution in the amount of $90,000.00 toward the cost of the 1,373-foot trail at 1700 Highway 96 W (the "Subject Property") in place of bearing the total expense of the trail as required in Condition 28 of Resolution 2025-007. The City Council reviewed the Developer's request and the adoption of Resolution 2025-040 with an amendment to Condition 28 at the April 28, 2025 City Council meeting and the staff report for this request is included as Attachment B. Resolution 2025-040 also included updated language to Condition 29, which references a 396-foot trail segment associated with the Development. Discussion was had about the amount of the proposed financial contribution. The Council discussed if the Developer could commit to increasing the financial contribution to which the Developer stated they could agree to a $100,000.00 contribution but would need to discuss any increases above $100,000.00 with the Development's financial partners.
