H. 10. <br />Christoffersen reported that he reviewed the preliminary construc- <br />tion plans for Traffic Noise Attenuators and Landscaping from Co. <br />Rd. H2 to T. H. 10; noted that prlmari Iy all landscaping Is proposed <br />In the Arden Hills portion. Christoffersen noted that the bid <br />letting Is scheduled on August 26, 1977; no CouncIl action Is <br />required; questions re the project may be directed to the Depart- <br />ment of Transportation. <br />, <br /> <br />Status of Storm Sewer Activities - Carlson Property on Bussard Court <br />ChrIstoffersen was requested to report re status of this drainage <br />problem at the July 25th Council Meeting. <br /> <br />. REPORT OF VILLAGE ATTORNEY JAMES LYNDEN <br /> <br />Case No. 77-22 - BueslnQ AQreement <br />Lynden referred Council to hIs letter of 7-8-77 and to Declaration <br />of Covenants and Restrictions which Is intended to be recor~ed <br />agaInst the land so that any transferee from Mr. and Mrs. BuesIng <br />will be bound by the.covenants and restrictIons contained therein. <br /> <br />Crichton noted that there Is no Intent to delay the spilt of the <br />property. City needs a land access from Hamllne Avenue to the <br />Highway 51 easement area for a pedestrian pathway between Floral <br />and Cummings Parks; parcel 14 was meant to provide this access <br />and fulfill a portion of the 10% park dedication to the CIty <br />attributable to the subdivision of the Buesing property. <br /> <br />Mr. William FInk, attorney representing Mr. and Mrs. Buesing, said <br />they will grant a 10% park dedication; parcel 14 Is considered to <br />be In excess of the 10%; may result In City paying $4,OOO~$5,OOO <br />for the parcel as delineated. Fink noted that It Is Important <br />to the Bueslngs to expedite the property spIlt so the sales can be <br />consumated as soon as possible. Fink said the easement must be <br />p~rchased from The State (Buesings are the underlying fee owners); <br />this can be obtained; ~$ked how much land the City proposes to <br />acquire. <br /> <br />Crichton explaIned that the City desires a strip of land running <br />northeasterly from the approximate 25' wide access from Hamllne <br />Avenue, to Cummings Park. Council reviewed a survey of the Buesing <br />property; noted that survey shows Buesing ownIng to the center of <br />the T. H. 51-125 easement (at previous CouncIl meetIng It was <br />stated that Buesing Is the underlying fee owner of the entire <br />easement width of 150~; actual size of the property Is unknown, so <br />park dedication cannot be settled. <br /> <br />Mr. Fink advised that Mr. Tietz, purchaser of parcel 13, has agreed <br />to take care of the park dedication for that parcel; consequently, <br />the dedication of parcel 14 exceeds the park dedication f6r the <br />balance of the Buesing property. <br /> <br />Lynden noted that If parce' 13 Is deleted from park dedicatIon at <br />this time, value of parcels 12 and 14 must be known to determine <br />the park dedication for this portion of the property; noted that <br />CIty can request an appraIsal to determine these values. <br /> <br />. <br /> <br />After discussion, Lynden agreed to meet with Mr. Fink and Councilman <br />Crichton at 10:00 a.m. on Wednesday, July 13th, In Lynden's office <br />re resolution of the park dedicatIon and conveyance of parcel 13 to <br />Mr. Tietz. <br /> <br />Wingert moved, seconded by Hanson, that Councl I approve the Declara- <br />tIon of Covenants and Restrictions as submitted. Motion carried <br />unanimously. <br /> <br />Police Union Contract <br />Lyndan briefly reviewed the Police Union Contract whIch Is the result <br />of In-depth dIscussions with Councilman Crichton, Incorporating <br />the changes previously agreed upon. <br /> <br />-2- <br />
