Miller reported that the Planning CommIssIon recommends approval of the lot spIlt. After dIscussion, Wingert moved, seconded by Hanson, that Council approve the lot spilt as per survey submitted. Motion carried unan I mous Iy. (Approval was made with the understanding that no varIances wIll be consIdered.) Case No. 77-34, Lot Spilt and Consolidation - Harold W. Riley, Jr. Miller referred Council to his report, and to a survey Indicating the proposed spIlt of a 40'wlde parcel of land; subsequent two (2) parcels to be consolidated with the adjacent lots. Miller reported that the Planning Commission recommends approval of the request. Woodburn moved, seconded by Wingert, that Council approve the lot spilt and consolidations as per survey submitted. Motion carrIed unanimously. Case No. 77-32. Lot Spl It and Consolidation - Alex Chvestulk Miller referred CouncIl to hIs report and a sketch of the proposed lot spilt and consolidation; noted that rear 289' Is to be con- solidated with the Milton property; reported that the Planning Commission recommends approval of the request. Woodburn moved, seconded by WIngert, that Council approve the lot spilt and consolidation requested contIngent upon receipt of the required survey. Motion carried unanimously. Case No. 77-35. Variance - Elmer L. Andersen MIller referred Council to his report and to the Planning Commis- sion recommendatIons (Minutes of MeetrnJ of 7-5-77) to approve the 8' front setback variance for a house to be located. on two . lots on Bussard Court cul-de-sac. WIngert moved that Council approve the 8' front variance, on the basis that the house will align with houses on the adjoining lots along the street, and on the basis of loss of tress and extreme grading If house Is sited at the 40' setback line. Motion was seconded by Hanson. In dIscussion, Woodburn noted that the trees may be lost anyway due to excavation disturbance; contour map indicates nouse can be sited at 40' setback lIne wIthout extensive gradIng. Crichton stated that he cannot see the merit of lining this house up with the existing house on the cul-de-sac; should not approve a variance If a hardship does not exist. Motion did not carry (Crepeau, Hanson voting In favor of the motion; Crichton, Woodburn, Wingert voting In oppositIon). -4-
