Minutes of Regular Council Meeting March 28, 1977
Page four

.

"working" sewer easement will be needed for the 20't cut required;
both sewer and water lines can be placed within the 40' wide ease-
ment (10' apart).

Harstad reported that Mr. Eibenstelner met with Parks Director Buckley
and they have worked out a pedestrlanway across two lots Clots 12
and 24, Block I) from Karth lake Circle to Nursery Hili lane; it creates
problems for the two lots (Invasion of private property); are not
~hrilled" with this path provision, but will agree to go along with it
at the 964' level, if It has to be.

Harstad said that Karth lake Estates and Karth lake Hills plats are
In alignment; have not done the grading plans to date, but feel con-
f I den t that setback requ I rements can be met on a II i ots _ a I i lots
meet code requirements. Harstad asked that Outlots C and 0, as pro-
posed, be considered to satisfy the park dedication requirements.

Nordling reported that Pilgrim House had stated previously that It
was confident that an agreement could be negotiated, based on this plat,
but has, to date, not come to an agreement; In order to al low the plat
to go ahead, P II gr I m House wi II se,ll the south 30' at the ave rage
cost/sq. ft. paid by the developer for the site, which he understands
to be about $6,OOO/acre.

Harstad countered that the 30'x204' portion of the Pilgrim House
property Isn't worth anything; the cost of the property is not for
public knowledge; figure quoted is not accurate.

Nordling said that Pilgrim House cannot, consequently, go along with
the plat and withdraws all agreements and opposes any condemnation
at less than the fair market value which, according to Mr. Elbenstelner
is about $6,OOO/acre. Nordling also presented an appraisal of the
Pilgrim House property for Council's consideration.

Mr. Picha repor+ed that he has entered Into an agreement with the
developer regarding his land, developer has agreed to plat a lot for
him In exchange for the 30'xl04' portion of his land.

Nord~ing advised that Pilgrim House does not want It's property platted.

After discussion, Wingert said that It would seem that further negotia-
tions can succeed, and moved that Council delay Its action on the
Preliminary Plat of Karth lake Estates to April II, 1977, pending:

I. An agreement between Pilgrim House and the developers.
2. Approval of the plat by the Fire Chief re cul-de-sacs.
3. Detarmlnatlon by City Engineer of sewer easement location
on the Hartmark property.

Motion was seconded by Woodburn and carried unanimously.

Relocation of the road, to by-pass PI igrlm House property, was suggested
as an alternative; Christoffersen noted that this may cause sewer align-
ment problems - may not be able to serve all properties If curve of
road Is abrupt. Another alternative suggestion was to skip the Pilgrim
. House property and cul-de-sac the street In front of lot 160.

Nordling asked Council to give consideration to a road from Highway 96 to
serve the Pilgrim House property for development in the future. Council
advised that regardless of whether Karth lake Drive cuts through the
Pilgrim House property, it Is not practical for Pligrim House to not
have a road abuttIng the south portion of Its property. Christoffersen
said he would also recommend that the road run adjacent to the Pilgrim
House property.

REPORT OF VilLAGE ENGINEER DONALD CHRISTOFFERSEN

Ore fus 8nterstate Develo ment Re uest re Maintenance Bond for Streets
In Hunters Park
Christoffersen referred Council to his letter of 3/22/77.

Woodburn moved. seconded by Crichton. that Council accept the S5,000
maintenance bond, as outlined In Engineer Ch~lstoffersen's letter; bond
to be in effect for one year from date of acceptance (February 28. 1977>.
Motion carried unanimously.

-4-
