Chr I stoffersell said that Inspection <br /> by Banister Is virtually Impossible for about two weeks; suggested that <br /> a good contractor will know what has to be done to pass the specs re- <br /> quirements (they have a copy of the specs.l; Banister would prefer <br /> to only Inspect for Arden Hi I Is, after work has been completed (not <br /> inspect our own Inspections). <br /> Counc II concurred that Banister should not perform Inspections during <br /> the corrective work at Arden Manor. <br />. REPORT OF PLANNING COMM1SSION <br /> Case. .N.o_.__76-3.6_,_.~t,!n,~ar_cL.(}~'-c..~mpany - Bu II d-'.flJ1.I".erll!it. <br /> Wingert referred Council to Minutes of the Planning Commission Meet- <br /> ing ('0-5-76) and to plans submifitid for car wash addition to the east <br /> end of the Standard 01 I Service Station, 1306 West CounTY Road E. <br /> Wingert noted that the Planning Commission determined that the one-bay <br /> cold water car wash proposed, is an accessory use, In its opinion, to <br /> the service station primary use of the property; recommends Council <br /> approva I of the BuildIng Permit. <br /> Wingert moved, seconded by Crichton, that Counc II authorize the <br /> Issuance of a Building Permit for the car wash adcltlon as per plans <br /> submitted with Case No. 76 -36. Motion carried unenlmously. <br /> (It was noted that Ordinance No. 132 (Service Station Ordinance) con- <br /> flicts with Ord. 99 (Zoning Ordinance); 132 does not permit vehicle <br /> wash and 99 does permit it as an accessory use.) <br /> Case No. 76-33, Buzzell Builders - Subdivision <br /> Wingert reported great opposition at the Public Hearing held by the <br /> Planning Commission ( 10-5-76) to the proposed development of the a rea <br /> (Tiller Lane, Hamllns Avenue and Ingerson Road); considers this to be <br /> swamp land and If filled, even partIally, they felt would cause water <br /> back-up Into basements of surrounding homes on I ngerson Road and <br /> Dunlap Avenue. <br /> ... ~. <br /> Wingert referred Councl I to the SubdIvision plans, as presented, pro- <br /> posing six (6) building lots (4 on Ti II er Lane and two (2) on Ham II ne <br /> Avenue) ; lots on Ingerson Road are already plattec lots and not part <br /> of the subdivision request. <br /> Wingert reported that he understands Buzzell Builders have withdrawn <br /> their purchase contract, since the Public HearIng; do not Intend to. <br /> pursue the subdivision proposed; consequently, no Counc I I action is <br /> required at this time. <br /> Wingert noted several req u I remen ts In the Subdivision Ordinance (No" 98l <br /> regarding subdivisions Involving water courses, areas which are subject <br /> to periodic flooding, contain extremely poor drainage facilities etc. <br /> It ~as also noted that the Building Code requires that houses be bul It <br /> on a so II d foundation; If soi I can't support a hou se, It Is Impossible <br />. to b u I I d on the site. <br /> ~ n discussion, It was suggested by Wingert that Council seek a solution <br /> re swamp areas, recognize them as wet lands and storage areas for local <br /> drainage; suggested that Council determIne what can be permitted In <br /> these low areas, and possibly the CI~y acquire these areas. <br /> Woodburn suggested that Engineer advise whether a holding pond could <br /> be created In this area, also creating a buildable area on the tract; <br /> ask Rice Creek Watershed to look at It also to see what It recommends <br /> for pond and for building: <br /> is pondlng feasible7 ~ s building feasible? I s filii ng feasible? <br /> etc. <br /> McNlesh was requested to ask Buzzel I to notify City, In wrltl ng, of his <br /> determination to withdraw or pursue the subdivision. <br /> Counc II deferred action pending receipt of Buzze Il'S decision to pursue <br /> or wIthdraw his application for Subdivision. <br /> -4- <br />
