Vac.tion of streets in Shady Oak plat. <br /> 6. Fi11ng of quit claim deed for roadway <br /> purposea for turn-around on lot 17. <br /> After review and discus.ion, McAllister moved, seconded by Wingert, <br /> that Council approve the final plat of Arden Oak. aubject to: <br /> 1. Approval of all eaaements (uti 11 ty, drainage and turn- <br /> around by the City Engineer and City Attorney. <br /> 2. lesolution of park dedication requirement. <br /> 3. Approval of proposed street names by the Poat Office. <br /> 4. Approval of atreets, utilitiea and Irading plans by <br /> City Engineer. <br /> 5. Vacation of certsin streeta in Shady Oaks plat. <br /> 6. Piling of appropriate deed for roadway purposea on lot <br /> 17, pur.uant to .Lynden I a recommendation. <br /> Motion carried unanimoualy (4-0) . <br /> It was also noted that the plat will not be executed until bida <br /> are awarded for the project. <br /> Case No. 81-28, Varisnce for Solid Six-foot Pence, 4542 and 4550 <br /> Pleasant Drive <br /> Council was referred to a tranaparency of the two subject lota ani <br /> surrounding area, and to recommendationa of Board of Appeala (l0- <br /> 3-81) and Planning Commiaaion (l0-7-81) . <br /> Applicants, Mr. Strunk and Kr. loe, were present and Mr. aoe ex- <br />. p1ained that he was not aware of the ordinance requirement of 30% <br /> open fence, or the building permit requirement, prior to construc- <br /> tion of the atockade fence acress hia rear yard. loe explsined <br /> thet the, fence waa constructed to shield his property from the <br /> lights, noiae, recurring uae of right-of-way for aelling varioua <br /> thinga - vegetablea, cars etc.. and to acreen from weeda; sdd <br /> he has planted twenty trees to also help alleviate theae prob lems. <br /> Strunk said he has the aame situation, and would like to continue <br /> the solid fence across his rear yard; has no objection to a 30% <br /> open fence on the side yard extenaion of hia propoaed fence, which <br /> is in tended to pro~ect child from the pond on the adj acen t lot. <br /> Miller briefly reviewed hi. cO\ll1llenta in Planning Memo (9-29-81) , <br /> and reported that the Planning Commiasion ~elt very atrongly that <br /> the major and minor arteriala prOVide unique expoaure of an ex- <br /> tremely buay interaection for theae two lots. <br /> -3- <br />
