Davis, 1848 Noble Road, stating he has no objec- <br /> tion to tbe proposed addition. <br /> After discussion, McAllister moved, sedonded by Johnson, that <br /> Council approve a 24' rear setback variance (6 I from rear property <br />. line) based on the following: <br /> 1- Substandard lot depth <br /> 2. Similar encroachment of structurea on adjacent lots <br /> 3. Inadequacy of rear yard <br /> Motion carried (McAllister, Johnson, Woodburn voting in favor of <br /> tbe motion; Wingert voting in opposition). (3-1 ) <br /> Ordinance 213 - Suggested amendment Relative to Dav Care or <br /> Reaidential Facility. <br /> Miller suggested that Council may wish to amend Ordinance 213 to <br /> brins it into conformance with State statues, which peraita 10 or <br /> fewer in day care facilitiea and 6 or fewar in reaidential facil- <br /> ities in residential diatricta. Miller explained that the law <br /> waa chansed; consequently the land use chart (Section V) ahould <br /> spli t day care from reaidential facility, or another alternative <br /> would be to remove them completely, and refer to State atatute. <br /> Miller auggested alao that Council determinations (e.g. recent <br /> de f ini tion of "patio" as an "accessory structure") be included <br /> when amending the zoning ordinance; noted that since ~heae are <br /> interpretations only, it is his understanding the change doea <br /> not require e hearing and notification. <br /> De ferred to a late r meeting. <br /> OTHER BUSINESS <br /> Landacape Inapection Reporta: <br /> Council waa referred to reports of Landscape Inspector Kruckenberg <br /> Arden Woods Office Bui Iding (Evenson) <br /> Wingert reported that he looked at the aite; feels confortable <br /> with what has been done, even though there are tremendous substi- <br /> tutions. Winsert moved that Council approve the landscaping and <br /> authorize reduction of the bond to that of a maintenance bond <br /> 000% of coat). Motion waa aeconded by Johnaon. <br /> In discussion, Johnaon expressed concern re amount of blacktop <br /> and its exposure to Lexinston/County Road F intersection. <br />. Winsert said it is the intent that the plantings on the islands, <br /> in time, will aoften the exposure of blacktop; noted that the <br /> interior of the site is very well done and charmins to walk <br /> th rough. <br /> Motion carried unanimously (4- 0) . <br /> Stareo Warehouse, 3771-3789 N. Lexington Avenue - Final Inspection <br /> Winsert reported a very minimum job of landscapins; have added tbe <br /> planting replacementa. but they are ve ry a ."11 and a crawny. <br /> After discussion. Wingert moved, seconded by McAllister. that <br /> Council accept the landscapins at the Starco Warehouse. Motion <br /> carried (Wingert. McAllister.
