The 54' height of part of the Fine Art. Center building <br />is acknowledged by both parties concerned to be in excess <br />of the 35' meximum permitted in re.idential districts by <br />Zoning Ordinance No. 99, and therefore subject to the pro- <br />vi.ion. of paragraph 5 of Section III-D .pecifying District <br />Provision. for beights, and tbat relief from such a height <br />restriction can be granted only by means of a SpeCial Use <br />Permit, and this application for building permit shell also <br />be viewed es an application for a Special Use Permit for <br />relief of said height limitation. <br /> <br />9.
