STATUS REPORI'; Clerk Administrator Berger reported on the status of KEITHSON POND negotiations for the easement relating to Keithson Pond, Berger stated Attorney Filla has been in contact with the legal counsel for Mr. Reiling and Filla indicated there does not appear to be any plans to develop the Reiling property in the near future, nor to resolve the easement agreement, Attorney John Miller was present and explained the precess for condenmation of the property. He also explained the "quick take" procedure and determination of public purpose; if the city is unable to obtain a waiver of trespass to accomplish the work necessary on the easement, possession would occur after 90 days frCllll the date of hearing. Council discussed the time-frame for installation of the pipe, based on the weather conditions, Engineer Maurer advised it would be relatively expensive and difficult to accomplish the construction during the winter months, He indicated it may be more appropriate to p1.lI1p the pond until the spring thaw occurs and ground conditions allow for installation of the pipe, Counci1member Mahowald suggested if there is any possibility of expediting the precess to allow installation of the pipe prior to ground freeze, it would be beneficial to pursue this action, There was discussion regarding preparation of a plan for installation of the . pipe and how the installation would relate to future development of the Reiling property . eounci1member Malone stated it would be helpful to have a background sheet on the Keithson Development and suggested staff review the planning files to prepare a fact sheet. Malone moved, seconded by Hicks, to direct the City staff to prepare a fact sheet with background infornation relating to the Keithson development, which includes planning infornation on the Preliminary/Final Plat, Council minutes and other pertinent information, prior to October 31. (5-0) Council recessed at 9:00 p,ro, and reconvened at 9:10 p.ro, Malone moved, seconded by Mahowald, to direct the city Engineer to prepare a preliminary design for drainage, as relates to the Keithson Pond area and future development of the Reiling property, Motion carried unaniJoclusly. AGREEMENI' FOR Powers Agreement with Ramsey County, for a Recycling CHARGES Service Charge, '!he Adrninistrator noted the attachments forwarded with his memorarrlum, He indicated the city Attomey has reviewed the agreement and believes it is in proper legal form, Berger stated this matter has been discussed infornally in the past.
