'!hat the drainage plan be approved by the City Engineer and RaID if deemed <br />appropriate and adjustments in the plan be made as necessary. <br />2. '!hat ornamental trees be planted at 30 ft. spacing along the west property <br />line, with adjustments as necessary to a=nmodate city utilities and access <br />for maintenance equipment, and the Planner approving the species installed. <br />3. '!hat minor adjustments in the parking stalls be permitted to allow for <br />specific tree and power pole locations, and to allow for access requirements <br />to the property to the north. <br /> <br />Motion carried. (Malone, GrcMe, Hicks and Sather voting in favor; Mahowald <br />opposed) (4-1) <br /> <br />Council was referred to a memorandum fran the Park <br />Director dated 9-6-91, requesting authorization to <br />purchase a Taro mower, frcnn MI'I Distributing. <br /> <br />Council1nember Malone recalled the initial request was for the mower and <br />attachments at a cost of $17,000.00. He questioned if quotes or bids were <br />received for the mower and attachments, as per previous direction fran CounciL <br /> <br />PURCHASE PARK <br />EJ;;!UllMENI'; MJWER <br /> <br />Park Director Buckley stated the attachments are not being purchased at this ti1ne <br />and no quotes or bids were received. <br /> <br />There was discussion with the City Atto:rney relating to whether or not this may <br />be construed as circumventing state statutes regulating the bid process for <br />purchases over $15,000.00. <br /> <br />Council concu=ed to direct the Parks Director to obtain sealed bids for all <br />three items he is requesting to purchase. <br /> <br />HAZMAT <br />AGREEMENT <br /> <br />Council was referred to the memorandum from the Clerk <br />Administrator dated 9-5-91, relating to the Hazrnat <br />Agreement. <br /> <br />Attorney Filla reviewed the agreement and the amendment which more clearly <br />defines the agreement as a shared service contract versus a Joint Powers <br />Agreement. <br /> <br />Council1nembers commended staff for an excellent job on the preparation of the <br />Hazrnat Agreement. <br /> <br />Malone moved, seconded by Mahowald, to authorize the <br />Mayor to execute the Hazrnat Agreement as suJ::mitted. Motion carried unanimously, <br />(5-0) <br /> <br />Council was referred to the memorandum fran the Clerk <br />Administrator dated 9-5-91, relative to the status of <br />the negotiations for the Keithson Pond easement. <br /> <br />There was discussion relative to the possible options for resolution of this <br />matter and determining the extent of financial obligation which may be placed on <br />the developer, the city and residents through the assessment procedures. <br /> <br />UPDATE; KEI'IHSON <br />POND EASEMENT <br />
