<br />Minutes of the Arden Hills Regular Council Meeting, 7-29-91 <br />Page 7 <br /> <br />CASE #91-09 The Planner referred to previous rezoning requests which <br />were approved by the City, allowing the rezoning to occur <br />only after the SUP and Site Plan were approved; cited Shannon Square on Lexington <br />Avenue as an exanple and noted the applicants agreed to such stipulation. He <br />indicated the city negotiates the developnent of such sites until the plan meets <br />approval and then the rezoning becomes effective. <br /> <br />. <br /> <br />Co1.mcil1nember Mahowald agreed with this approach for negotiating quality <br />development of this site. <br /> <br />Planner Bergly stated Attorney Filla agreed with this approach f= the few <br />remaining vacant parcels of land in the City. <br /> <br />Malone 11DVed, seconded by Mahowald, to contingently <br />approve the Rezoning from B-1 to B-2, Case #91-09, Cleveland Avenue and County <br />Road E-2, Hans Hagen, pending Co1.mcil review and approval of a Special Use Pennit <br />for a Service station/Convenience store/Car Wash at this location, and all <br />related site plan materials, and the issuance of a b.Jilding permit f= <br />development of this site, prior to the rezoning becoming effective, and Council <br />further advises the applicant that such contingent approval of the rezoning does <br />not imply that approval of the Special Use Pennit or issuance of a b.Jilding <br />permit is guaranteed, with such approval to expire within one year.
