<br />Minutes of Regular Council Meeting <br />March 28, 1983 <br />Page Four <br /> <br />.' <br /> <br />, <br /> <br />After discussion motion was amended to include maintenance by <br />property owner to gravity section of sewer line. <br /> <br />Hicka stated that he doesn't feel Reiling should be assessed for <br />900', suggested that about 250' of force main which would not <br />benefit Reiling, could be added to Neilsen property resulting in <br />an estimated assessment of $10,520 to Reiling, $13,480 to Neilsen. <br />He further suggested that at the assessment hearing he would rec- <br />ommend that payment on the Reiling assessment be deferred until <br />his property is developed. <br /> <br />Reiling stated that if he appeals the assessment, and is success- . <br />ful, eventual cost to Nielsen property would be higher than if <br />Option 2 were adopted now.(It was noted that City would have to <br />absorb the costs, Neilsen could not be re-assessed). <br /> <br />Woodburn called for <br />votes for passage. <br />Christiansen, Hicks <br /> <br />the motion, noting that this requires four <br />Motion did not pass. (3-2) (Woodburn, <br />in favor, McAllister and Mulcahy opposed). <br /> <br />In further discussion, Mulcahy said he would like some answer to <br />indemnity queation, feels he is very reluctant to incur costs of <br />litigation in case of appeal. McAllister reiterated her feeling <br />that taxpayers should not pay any of the cost of this sewer. <br /> <br />Christiansen discounted concern about a potential lawsuit, does <br />not think this should enter into decision. Woodburn reiterated <br />that concern should be in doing what's fair for the Village, then <br />consider other problems involved. <br /> <br />McNiesh stated that deferred assessments have been granted to <br />senior citizens; law states that assessments can be delayed until <br />s site is developed. <br /> <br />Mulcahy said he preferred to see some action on the matter and <br />moved to reconsider the previous motion, seconded by McAllister, <br />motion carried unanimously (5-0). <br /> <br />Motion to adopt Option 1 as amended carried unanimously (5-0). <br /> <br />REPORT OF VILLAGE TREASURER DONALD LAMB <br /> <br />Investments <br /> <br />3-17-83 <br /> <br />$190,411.68 at Twin City Federal @ 8.90%, <br />maturing 9-19-83. <br /> <br />$431,739.79 at Twin City Federal @ 8.90% <br />maturing 9-19~83. <br /> <br />3-28-83 <br /> <br />$105,687.50 at First Federal @ 9.25% <br />maturing 9-28-83. <br /> <br />Hicka moved, seconded by Christiansen, that Council ratify the <br />Treaaurer's report. Motion carried unanimously (5-0). <br /> <br />. <br /> <br />Revised Use of Federal Revenue Sharing Monies <br />The Public Hearing was opened at 9:50 p.m. and Clerk Administrator <br />verified that the Notice of Hearing was published in the New <br />Brighton Bulletin on March 10, 1983. A transparency of McNiesh's <br />memo was displayed showing the Proposed Revised Use of Revenue <br />Sharing money for 1982. Amounts spent in 1982 for Public Works <br />and Parks equipment were not as large as anticipated, so part of <br />the cost of the Civil Defense siren is being paid with Revenue <br />Sharing Funds. <br /> <br />McAllister moved Council approve the Revised Uses of Federal Rev- <br />enue Sharing Funds in 1982. Motion was seconded by Hicks, carried <br />unanimously (5-0). Public Hearing was closed at 9:53. <br /> <br />-4- <br />
