Mrs. McNiesh are there any written <br />comments on the proposal? <br /> <br />CHARLOTTE MC NIESH: None, your honor. <br /> <br />MAYOR WOODBURN: Thank you. Then, we'll open the Public Hearing <br />to comments from the audience. We will start with anyone who <br />wishes to comment. <br /> <br />. <br /> <br />TIM NELSON: Honorable Council and Mayor, my name is Tim Nelson. <br />I'm attorney for the applicant J.L.N. Development. Our prefer- <br />ence is the obvious one, to put in the gravity system for the <br />length it can be and the force main for the smaller portion. We <br />feel the combination of gravity and force main will serve future <br />growth of the western portion of the Reiling property and it <br />would be more reasonable and farsighted on the part of the City <br />to provide for potential growth of Mr. Reiling's property. We <br />think that standards should apply and that it ia clear from (in- <br />audible) Minnesota Case (inaudible) interpreting the statutes, <br />that some benefit by way of increased property value would re- <br />sult to Mr. Reiling's property for the portion served by this <br />improvement. The (inaudible) feels that it is not that it <br />necessarily improves the current use of his property but has <br />some potential future benefit however it might develop. The <br />statutes are pretty clear on that. <br /> <br />(inaudible) another option was considered at one point in time <br />and that was a private septic and drainfield system. Our engin- <br />eer (inaudible) B.R.W. has indicated that the private system is <br />not a realistic or feasible alternative at this point in time <br />because (inaudible) of the soils makeup in this area and because <br />of (inaudible) maintenance problems in the future. (inaudible) <br />probably the most important reason is that the approved plan for <br />the property would require a complete restructuring for an on <br />site sewer system. (inaudible) <br /> <br />The Boss/Nielsen property has been subject to previous assessments <br />in the past for water, sewer and storm sewer; has one payment <br />left on a 1963 sewer assessment relating to the trunk line through <br />the Reiling property and there is the $4500 storm sewer assessment <br />last year. It would be rather cruel irony to have paid for sewer <br />assessments over the years (inaudible) improvement which was de- <br />signed to aid the industrial property in the area and then (in- <br />audible) not be able to develop the property because it is not <br />served with a similar sewer as other properties (inaudible) to <br />recap, the force sewer line (inaudible) cheaper in the short run <br />but more expensive in the long run in that the likelihood is <br />great that the Reiling property will be developed and will re- <br />quire sewer service on some portion of the property, and converse- <br />ly the gravity system is flexible providing for additional develop- <br />ment on the Reiling property (inaudible) request option number one <br />which provides gravity sewer and the shorter force main service <br />to the Nielsen property. <br /> <br />. <br />
