<br />Minutes of Regular Council Meeting <br /> <br />May 24, 1982' <br /> <br />It was explained that publication of the Agenda has been consid- <br />ered; because of the time frame, the agenda would not be complete <br />by Tuesday. It was noted that the Agenda is currently posted at <br />McCuires and at the Village Hall; could publish a "tentative" <br />agenda. <br /> <br />It was suggested that the "Town Crier" notify residents that the <br />Agenda is posted at McGuires and the City Hall; some feel publi- <br />cation of a "tentative" agenda would be hel~ful. <br /> <br />REPORT OF VILLAGE ATTORNEY JAMES LYNDEN <br /> <br />Authorization to Execute Railroad Crossing Agreement - <br />. Grey Fox Road' . <br />Council was referred to Lynden's letter of 5-18-82 Re: Proposed <br />Railroad Crossing Grey Fox Road Agree.ent with Soo Line Railroad <br />Company, and to Soo Line's letter of 4-28-82 re: Proposed Estab- <br />lishmentment Public Grade Crossing Grey Fox Road, Arden Hill. <br />(Cardigan Jct.) , MN. <br /> <br />Lynden noted the indemnity clause has been deleted and recommended <br />execution of the Agreement. <br /> <br />After discussion, Hicks moved, seconded by McAllister, that Council <br />authorize execution of the Railroad Crossing-Grey Fox Road Agree- <br />ment with Soo Line Railroad Company. Motion carried unanimously <br />(4-0) . <br /> <br />Petition to EQB <br />Lynden reported thst he meet with EQB requesting that the Petition <br />be dismissed relative to the road through Floral Park; reported <br />the Board voted unanimously to dismiss the Petition, finding it <br />frivolous and without merit; road has no adverse effect on the <br />environment. <br /> <br />Complaint <br />Lynden said the Complaint was served on May 10th, will file a. <br />response; noted the City intends to defend the case as vigorously <br />as it possibly can. <br /> <br />REPORT OF VILLAGE ENGINEER DONALD CHRISTOFFERSEN <br /> <br />Lexington Avenue Reconstruction - City Concurrence in Award to <br />Low Bidder, Shafer Contracting Co. Inc. <br />Christoffersen reported that the concrete curb and gutter bid <br />costs received will increase Arden Hill's costs from $18,900 to <br />$23,130; cost estimate at Public Hearing of $23,900 included City's <br />anticipated easement costs for r.o.w.; noted that if all costs are <br />in, the increased curb and gutter costs are still within the esti- <br />mated cost of the project. Christoffersen recommended City's <br />approval of contract award; is in the range of estimated costs. <br /> <br />Hicks moved, seconded by McAllister, that Council approve award <br />of the contract to low bidder, Shafer Contracting Co. Inc. Motion <br />carried unanimously (4-0). <br /> <br />STH 96 Improvements - Concurrence re Closing Medians . <br />Christoffersen referred Council to his memo of 5-21-82 re: MnDOT <br />Improvements to Highway 96; reported the plans are for safety and <br />maintenance improve.ent consisting primarily of pavement overlay, <br />paved shoulders and turn lanes. <br /> <br />, <br />Christoffersen reported the plans provide for the closing of five <br />median cross-overs at private driveways (4 between Hamline and <br />Lexington and 1 between Hamline and Snelling (immediately west <br />of the City Hall). <br /> <br />Christoffersen suggested Council may wish to consider moving the <br />Public Works/City Hall cross-over to the east to increase the <br />sight distance by about two seconds, making the cross-over more <br />visible to both east bound and west bound traffic on Hwy. 96; <br /> <br />-2- <br />
