. . /' Minutes of Regular Council Meeting May 24, 1982 It was noted that Council conferred with Village Attorney relative to appropriate procedure to reconsider a motion; motion to re- consider must be made by the prevailing side; motion failed; there- fore motion to reconsider must be made by Woodburn or Johnson. Martin Harstad said he asked that the motion be reconsidered be- fore a full five member Council; only four members voted result- ing in a 2 to 2 tie. Woodburn explained that the Council operates by Roberts Rules of Order; this rule is meant for fairness; requests for reconsider- ation of a motion could occur every time five members are not present, if this procedure were not followed. Keith Harstad suggested that Council is neglecting one fact - action was taken when Council knew it was selecting another Coun- cil member. Harstad explained that his son asked for the oppor- tunity of presenting the propossl to the five member Council; asked that Council give the new Councilman the opportunity to act on the application. No motion wss made to reconsider the previous May 10th motion. Approval of Summer Playground Leaders and Summer Psrk Maintenance Employees Council was referred to Buckley's memo of 5-20-82 recommending the hiring of summer park maintenance and summer program employees. After discussion, Hicks moved, seconded by Johnson, that Council approve the hiring of the parks summer maintenance and program staff as outlined in memo. Motion carried (Hicks, McAllister, JOhnson, Woodburn voting in favor; Mulcahy abstained) (4-0-1). Resolution No. 82-32, Approving Amendment to Fire Protection Agree- ment dated the Third Day of October, 1977 McAllister moved, seconded by Johnson that Council adopt Reaolu- tion No. 82-32, APPROVING AMENDMENT TO FIRE PROTECTION AGREEMENT DATED THE THIRD DAY OF OCTOBER, 1977. Motion carried unanimously (5-0). . Public Safety Committee Recommendations Council concurred that a letter be sent to Lake Johanna Volunteer Fire Dept. advising that the City will provide the department with updated plat maps and group home listings on an annual basis. 1982 Sealcoating Council was referred to Johansen's memo of 5-21-82 re 1982 Seal- coating, and to a five year sealcoating plan, indicating streets proposed for 1982 sealcoating colored in brown. After discussion, Hicks moved, seconded by McAllister, tha~ Coun- cil approve the 1982 sealcoating plan as outlined on the map, authorize preparation of plans and specifications and authorize advertisement for bids. Motion carried unanimously (5-0). It was suggested that Johansen and/or City Engineer examine the City streets to determine whether or not five year seslcoating is adequate to properly preserve the streets. Purchase of Flsil Mower Council was referred to memo from Johansen (5-21-82) relative to quotes received for a new Flail Mower; recommending acceptance of quote from Midway Tractor. It was noted that both quotes include trade-in. Midway Tractor and Equipment has mower in stock for immediate delivery, Case Power and Equipment does not. Hicks moved, seconded by Mulcahy, that Council authorize purchase of the Flail Mower from Midway Tractor and Equipment @ $1910.00 Motion carried unanimously (5-0). -5-
