Rd. F <br />Killer reported that the Planning Commission held the Public Heer- <br />ing on this Special Use Permit request on April 7th; no public pre- <br />sent at the hearing. <br /> <br />Killer explained that the bus terminal is a non-conforming use in <br />the R-1 District; therefore the first issue is to determine <br />whether or not the proposed L.P. tank conatitutes an expansion <br />of this non-conforming use; noted it was determined by a previous <br />Council that the formerly approved diesel fuel tank was operation- <br />al only and not considered an expansion of the non-conforming use. <br /> <br />Council was referred to Planning Kemo (3-31-82), Planning Commis- <br />sion Minutes of 4-7-82 and to transparency of the Columbia Transit <br />site indicating the proposed location of the 11,000 gallon L.P. <br />tank. <br /> <br />Killer reported the Planning Commission concerns re safety, and <br />tbe Commission's recommendation tbet Council approve tbe tank <br />oriented east/west, instead of nortb/south aa ahown, with no <br />acreening, and contingent upon aix contingencies listed in the <br />Planning Commiaaion Kinutes (4-7-82). <br /> <br />A photograph of tbe tank, at Columbia Transit's terminal at Como <br />and Snelling, was sbown to Council, and a revised site plan, with <br />tbe tank oriented east/west, as recommended by the Planning Com- <br />mission was reviewed. The applicant reported that the State Fire <br />Karshal has also approved the east/west orientation of the tank. <br /> <br />In discussion, it waa noted that tbe proposed tank at the Arden <br />Hills terminal will be the same aa the one shown in the photo, <br />which ia a refurbished rail car. It was explained that burying <br />the tank is possible (tank would actually be "buried above ground"; <br />tank would be covered with dirt, not below the existing surface). <br />It was explained thet the reason for this is that propane is <br />heevier than air and would flow through the earth and possibly <br />get into sanitary and storm sewers. <br /> <br />It was noted that the Columbia Transit tank, at the Como facility, <br />is covere~with a fire-proofing treatment required by St. Paul.; <br />tank is 11/16" steel. <br /> <br />. <br /> <br />Concern was e~pressed by Johnson re the tank located 75' from <br />gasoline pumps; a fire could occur. Johnson said he doesn't <br />appreciate this size tank above ground; would like to lower the <br />profile; noted that the tank may not be expanding the existing <br />non-conforming use, but it makes sure the non-conforming uae re- <br />..ains the re. <br /> <br />McAllister moved, seconded by Hicks, that Council approve the <br />Special Use Permit for the 11,000 gallon L.P. tank as oriented in <br />the amended site plan (received 4-12-82). <br /> <br />Hicks moved to amend the motion, adding the following conditions: <br /> <br />e. Tank installation meets fire code requirements in <br />letter from State Fire Marshal (dated February 26, <br />1982) and the requirements of the local Fire Chief. <br /> <br />-3- <br />
