<br />Page 2 <br /> <br />commercial, Sikora showed slides of their recently constructed Birch Lake <br />Plaza on STH 96 in White Bear Lake; explained that Shannon Square will be <br />similar to the White Bear Lake convenience center, including a Q-Superette; <br />noted that the color of the superette canopy will be coordinated with the <br />proposed blue of the shopping center, otherwise will be the same as the Birch <br />Lake Plaza canopy. Sikora said that the edges of the canopy will be used for <br />signage; no advertising is permitted under the canopy. <br /> <br />In discussion, Hicks reported that the Planning Commission has requested <br />revision of the landscaping at the entry and pond area; also wants assurance <br />that the developer has an agreement with the adjacent property owner relative <br />to the pond's joint ownership, and a utility easement across the adjacent <br />property for sewer and water service to this site. Hicks reported that an area ~ <br />resident expressed concern, at the public hearing, that the area is similar to <br />a bowl, catching and holding gasoline odors. Hicks asked if there is any <br />technology on this potential problem. The representative of Q-Service said he <br />is not aware of this type of problem; stated would have to occur during a <br />fueling operation; noted that all pumps are vented - suggested it would have to <br />be a "housekeeping" problem, when trucks are unloading. <br /> <br />In answer to Hicks inquiry, Zehm said the Shannon Square site is subject to <br />park dedication. <br /> <br />Woodburn expressed his specific concern re the exterior lighting, especially <br />the height of light standards and concealment of light source so it is not <br />visible from adjoining lots or streets, <br /> <br />Hansen moved, seconded by Hicks, that Council approve the rezoning to B-2 <br />(General Business), rezoning to occur simultaneously with issuance of the <br />building permit for Shannon Square; bases for the rezoning are: <br /> <br />1. Satisfies the criteria for commercial expansion stated in the <br />Comprehensive Plan, <br /> <br />2. Does not adversely impact the operation and safety of Lexington <br />Avenue more than permitted uses of the existing zoning district. <br /> <br />J. Does not introduce uses which are out of character with the other <br />development along Lexington Avenue. <br /> <br />4. Is not considered spot zoning because site is contiguous to an <br />existing B-2 District and is of substantial size. <br /> <br />Motion carried unanimously. (4-0) <br /> <br />Hicks moved, seconded by Hansen, that Council approve the minor subdivision <br />(lot split and consolidation) because the lot split satisfies all ordinance <br />requirements and does not adversely affect the lot being reduced in size. <br />Motion carried unanimously. (4-0) <br /> <br />Hansen moved, seconded by Sather, that Council approve the Special Use Permit <br />for the operation of a service station based on the following conditions: <br /> <br />1. Service station signage to conform to signage plan of center and <br />City sign ordinance. <br /> <br />. <br /> <br />2. All lighting under and around the canopy to have hidden light <br />source, as viewed from public street and adjacent properties. <br /> <br />J. Exterior storage/display of products to be contained in appropriate <br />cabinets and racks and placed clear of traffic circulation space. <br /> <br />4. Only fuel and oil dispensing and miscellaneous automobile products <br />to be permitted, <br />
