<br />. <br /> <br />. <br /> <br />~ <br /> <br />Minutes of Regular Council Meeting <br />Monday, September 24, 1984 <br />Page Three <br /> <br />A transparency of the proposed use of Federal Revenue Sharing <br />Funds in 1985 General Fund Budget was shown. <br /> <br />After determining that there were no comments or questions from <br />the floor, the public hearing was closed at 8:06 p.m. <br /> <br />Mulcahy moved, seconded by Hansen, that Council approve the use <br />of Federal Revenue Sharing Funds in 19B5 General Fund Budget as <br />proposed. Motion carried unanimously. (5-0) <br /> <br />Budget Resolutions <br />Rauenhorst moved, seconded by Hicks, that Council adopt the <br />following Resolutions: <br /> <br />No. 84-29, Certifying Special Assessment Installment to <br />Ramsey County for Collection with Taxes (2 Municipal Water <br />Connections) <br /> <br />No. 84-30, Certifying Special Assessment Installments for <br />Diseased Tree Removal to Ramsey County for Collection with <br />Taxes <br /> <br />No. 84-31, Certifying Special Assessments for Delinquent <br />Sewer and Vater Accounts to Ramsey County for Collection <br />with Taxes <br /> <br />Motion carried unanimously. (5-0) <br /> <br />Fill Permit - Lots 6, 7 and 8, Block 12, Lakeshore Homesites, <br />David Cmie1 <br />David Cmiel distributed a memo to Council from Tom and Dorothy <br />Heller and Dave and Diane Cmiel (owners of the lots), describing <br />existing and proposed site information. <br /> <br />Cmiel explained that they have a verbal contract with Jacobsen's <br />Excavating to place the dirt, grade and seed the site. Cmiel <br />explained that the sewer line is about 8' down; cannot build a <br />residence at the existing contour unless sewer line is re-done to <br />make it usable; reported that the fill is available now; explained <br />that their intent is to make the lots usable for future con- <br />struction. <br /> <br />Cmie1 advised that the filling will not encroach on the lake <br />refuge, or on the drainage area, north of the property; does not <br />know the final lot elevation but will probably be at about the <br />same elevation as the street. <br /> <br />Rauenhorst noted that the issue is the filling without a permit. <br />It was noted that the Planning Commission is currently considering <br />Zoning Ordinance modifications, including the requirement of a <br />Special Use Permit for fill in excess of 400 cubic yards. <br />Filling of another parcel, without a permit, was also noted. <br /> <br />Rauenhorst moved, seconded by Hicks, that Council postpone action <br />until the October 15th meeting, pending information from owner of <br />the other fill site, and pending recommendations from the Planning <br />Commission relative to fill requirements. Motion carried unan- <br />imously. (5-0) <br /> <br />It was the understanding of the Council, Cmiel and Heller that fill, <br />grading and seeding be completed on lots 6, 7 and 8, block 2, <br />Lakeshore Homesites by October 15th and that permit requirements <br />be fulfilled after zoning ordinance modification relative to fill <br />has been approved. <br /> <br />Cmiel and Heller said they have no problem with the motion; <br />will complete by October 15th pending favorable weather conditions; <br />agreed to prevent erosion into the lake and drainage way. <br />
