<br />Minutes of Regular Council Meeting <br />Monday, January 30, 1984 <br />Page Three <br /> <br />Council was referred to draft of proposed Declaration of Covenants, <br />Conditions and Restrictions on the proposed Lamettl Addition, <br />which were drawn by Hoganson for Council's review. <br /> <br />In discussion, the following concerns were expressed re Article <br />No. V (p.4), Restrictions on Common Area: <br /> <br />. <br /> <br />Mulcahy: <br /> <br />A. Docks - would prefer that the 2 45' long docks not have <br />a "T" ending; asked consideration of this I ImItatIon. <br /> <br />B. Boat LaunchlnQ - not In favor of a boat launch facility; <br />feels there Is an adequate public boat launch area at <br />the north end of the lake; noted that a launch area <br />can cause difficultIes the association may wish to avoid; <br />suggested the gentle slope of the beach area, even If <br />no permanent launch exists, would permit reasonable <br />boat launching for the residents. <br /> <br />C. FenclnQ - noted that wooden fence Is proposed; noted that <br />a 3t' height fence would be permitted along the street <br />property lIne and 6' heIght beyond the 40' front set- <br />back lIne (fence to be 30% open). <br /> <br />Section XI D. Amendments (p.12) <br /> <br />expressed concern that the DeclaratIon may be amended by <br />2/3 of the membershIp of the assocIation; could amend or <br />terminate the declaratIons whIch are of most concern to <br />the Councl I; asked Hoganson's experIence; suggested <br />Inserting a time period before amendments can be made, <br />or Identifying certaIn areas which are not amendable; <br />suggested that If changes are to be made, why spend <br />time on covenants. <br /> <br />Hogansen said he used 2/3 rather than a simple maJority; <br />noted that this would be 9 out of the 14 property owners; <br />explained that It Is difficult to foresee future thinking <br />of potential property owners. <br /> <br />Christiansen and Rauenhorst concurred that 2/3 seems too lenient. <br />Rauenhorst suggested future changes require a 90% vote, as <br />opposed to 2/3; suggested that the common area covenants not be <br />amendable, unless approved by the Council; suggested Article V <br />be a separate declaration. <br /> <br />Mulcahy referred to J. (p.9) Notice of Certain ChanQes; suggested <br />the addItIon of Clt:i-o...L.f.rden--'iLlli - "Each FIrst Mortgagee, and <br />the City of Arden Hills, shal I be entitled to a 30 day notice ___"; <br />suggested this be added In approprIate areas of the declarations. <br /> <br />Rauenhorst asked If a concensus has been reached on a boat launch. <br /> <br />. <br /> <br />Rohrer asked If the appearance of a blacktop pad Is <br />offens.ve, or the launching of boats; explained that <br />they propose to put the launch at the north of the <br />common area - It can be of grass, sand or blacktop and <br />be screened wIth bushes; noted that they will prohIbIt <br />any parking of vehicles and boats on the common area, but <br />want to be able to put boats Into the lake; noted that <br />the aesthetics afforded by the lake are an Important <br />part of the amenities these .lots will otter. <br /> <br />Mulcahy said he thinks the first thing requested will be some <br />kind of restrIction to unauthorized boat launch use. <br />
