The City would not be <br />.- responsible for snow plowing, ground maintenance, electricity or future reconstruction as <br /> long as there is an occupant in the building that currently houses DynaMark. Any <br /> additional light fixtures or necessary ADA adaptations would be at the City's expense. <br /> 3. The lease would be perpetual and renewable at the City's option. The length of time will <br />I need to be determined by staff and the City Attorney. <br /> 4. CDC wants to retain the ability to move the designated parking stalls to another area as <br /> necessary if additional buildings are added to the site. <br />I 5. CDC will provide the City an easement to access the parking lot. The parking area does <br /> require access through private streets in order to get to Femwood Avenue or Lexington <br /> Avenue. <br />I 6. CDC will also give to the City a 100 foot strip of property west of the parking lot and east <br /> of our existing trail. The City currently has a 70 foot pedestrian and bike easement over <br />I part of this. Accepting this property would give the City fee title and provide the City <br /> with the option to develop this area, or preserve it as a buffer strip between the adjoining <br /> residential district. <br />I Recommendation <br /> I recommend that the City Council move to approve the park dedication agreement as outlined <br />I above. City Attorney, Jerry Filla, will be drafting a lease in the near future. <br /> The Parks & Recreation Committee has recommended the same.
