I~ ...
I MINUTES
I- CITY OF ARDEN HILLS, MINNESOTA
WORKSESSION
AUGUST 19, 1996
4:30 P.M. - PUBLIC WORKS BUILDING LUNCHROOM
I CALL TO ORDERlROLL CALL
Pursuant to due call and notice thereof, Acting Mayor Aplikowski called to order the City
I Council worksession at 4:35 pm. Present: Councilmembers Beverly Aplikowski, Dale Hicks and
Paul Malone, with Councilmember Susan Keirn arriving at 5: 10 p.m.; City Administrator, Brian
I Fritsinger; Public Works Superintendent, Dwayne Stafford; Community Development Director,
Kevin Ringwald; Parks and Recreation Director, Cindy Walsh; City Accountant, Terry Post;
Recording Secretary, Sheila Stowell, with Consulting Engineer, Greg Stonehouse, arriving at
I 4:55 p.m. Mayor Probst was unable to attend the meeting.
ROUNDTABLE DISCUSSION
I a. Committee Reports
No Committee Reports were presented or received by the Council.
I b. Department Head Reports
Department Heads provided the Council with a brief review oftheir respective
departments.
.. Public Works Supervisor, Dwayne Stafford, brought an item to the Council's attention
regarding a property owner in the Valentine A venueN alentine Crest area who had almost
I completed the installation of a retaining wall, which encroaches on the City's street right-
of-way easement. The wall has the potential for utility and snowplowing problems in the
future. The retaining wall is in violation of Minnesota State Statute and Municipal Code,
I but as addressed by City Administrator Fritsinger, due to the layout of the property and
existing trees and landscaping, the property owner didn't have many options in the
I placement of the retaining wall.
It was noted by Mr. Fritsinger and Mr. Stafford that future improvements by the City or
I future owners of this particular property could cause major expense for the City and/or
property owner. Historically, the City hasn't been very aggressive in monitoring
encroachments into the City's rights-of-way.
I It was the consensus of the Council that the retaining wall be left as constructed.
However, staff was directed to notify the property owner that the retaining y,"all was
I illegal, and that the property owner may be required to remove or maintain the area in the
future as the City dictates. This is so the City does not incur additional expense to
taxpayers due to the wall's installation. Council directed that copies of the letter be
I provided to the Accounting Department for assessment and filing purposes and the Public
Works Departments for future reference regarding street improvements in that area.
..
I
