<br /> '2-713 I <br /> I <br /> I wanted to talk with the fire chief before discussing the matter with the city. When he called back -- <br /> about a week later, the fire chief advised me that: <br /> a) LJVFD thought the land in question was community land* <br /> b) LJVFD had discussed the matter with the City and there were other problems, I <br /> including the need to widen the driveway to 25' <br /> c) LJVFD had hired an engineer and a contractor to design and build the parking lot for I <br /> them. LJVFD apparently didn't know that they needed a building permit or that they <br /> were out of compliance with the special use permit under which LJVFD operates ** I <br /> d) LJVFD would seek a variance and needed to get the names of property owners with- <br /> in 350 feet for the City. The fire chief took my name/address to add to the 1ist.*** <br /> e) LJVFD had granted an easement to the property owner to the north of the parking lot I <br /> as they prepared to build the parking lot <br /> On August 28,1996, my sister who lives on Lake Johanna Boulevard telephoned to tell me that she I <br /> had just been approached by a LJVFD firefighter to sign a petition to save four trees (see attachment <br /> 2-9, the cottonwoods in question and attachment 5, the petition circulated by the fire department I <br /> on August 28th) and to sign the variance which would not require widening the driveway. The <br /> language also referenced "the new driveway." When talking with the firefighter, and four others who <br /> were soliciting signatures in the area, it became clear that the firefighters were not aware that the .. <br /> parking lot itself represented a zoning and permit issue. The fire chief and I talked that evening. He <br /> felt the petition and signatures was a separate issue and it was unnecessary for LJVFD to have made <br /> residents aware of the other part of the reason for the hearing. 1 emphasized that if LJVFD chose to I <br /> use the signatures (which he emphasized were only solicited from those people living within 350 feet <br /> of the fire station), the way in which the petition was presented to residents should also be brought <br /> to the attention of the Planning Commission. I <br /> . Hard to fathom that since my surveying stakes and LNFD stakes were within inches of each other and 1 had I <br /> introduced myself as the neighbor abutting to the east in our prior telephone conversation <br /> .. Besides a potential conflict of interesl, it is unusual that neither the engineer, the contractor, nor LJVFD knew I <br /> that the parking lot broke a number of Zoning and Special Use ordinances. <br /> ... 1 did not receive a copy of the Notice of the Special Hearing. Upon calling City Hall, 1 was told it had gone <br /> out and my name was not on the list LJVFD submitted. The city faxed me a copy. 1 called the fire chief.
