(Cont'd) Peters stated that would be an option for the property <br />owner; he also explained the ditch construction was not <br />included as part of the cost estimate. <br /> <br />Michael Daub advised he would continue to discuss the most feasible method of <br />driveway repairs with the city staff on behalf of the Albjergs. <br /> <br />Councilmember Mahowald stated he originally had reservations relative to <br />assessing for the improvement. He pointed out that the city does not currently <br />have an assessment policy and he agreed with Malone that if there is no <br />assessment imposed to the residents it would be levied against the general <br />taxpayers; it appears there is clearly some benefit to the residents in the area. <br />He preferred some partial assessment to residents in the area~ <br /> <br />Councilmember Malone asked if a percentage of the costs could be assessed to the <br />affected/benefitted property owners. <br /> <br />Attorney Filla stated the city has the option to assess a portion of the costs by <br />setting a percentage; the Council has time to discuss and determine an assessment <br />policy prior to the hearing date. He advised the Council would then order the <br />preparation of the assessment roll and set a date for the assessment hearing. <br /> <br />Engineer Peters explained that normally the assessment hearing is held after the <br />construction is completed in order to include all costs in the assessment roll. <br /> <br />There was discussion relative to preparation of the assessment roll and the <br />time-frame for the assessment hearing. <br /> <br />Councilmember Growe suggested assessing the property owners 50% and the city <br />paying 50%; it was her opinion this would be a fair and equitable solution. <br /> <br />Filla reminded Council it is necessary to acquire the necessary easements to <br />construct the improvement and those costs will be included in the improvement. <br />He suggested the contractor for the project may be able to provide the driveway <br />repairs at 1680 Oak Avenue and it may be beneficial for the homeowner to have the <br />repairs done in conjunction with the improvement. <br /> <br />Malone moved, seconded by Mahowald, that Council approve <br />Resolution No. 89-33, Relating to Improvement No. ST-89-02, Oak Avenue Declaring <br />Costs to be Assessed and Ordering Preparation of Proposed Assessment Roll, and <br />amending item #1 to read: <br /> <br />1. That the total cost of the above described improvement shall not exceed a 50% <br />assessment against all properties benefitted by said improvement. <br /> <br />and, further setting the public hearing on the assessment for the first Regular <br />Council meeting in September, 1989. Motion carried. (Malone, Mahowald, Growe and <br />Sather voting in favor; Hansen opposed) (4-1) <br />
