Minutes of the Arden Hills Regular Council Meeting, May 30, 1989 Page 7 1988 FINANCIAL REPORT; AUDITOR GARY GRUEN Council was referred to a memorandum from the Clerk Administrator dated 5-26-89 relative to the management report submitted by Auditor Gary Gruen. Gruen reviewed the 1988 Annual Financial Report and outlined the items listed in his letter of 5-24-89. Council accepted the financial report submitted and thanked the auditor for his attendance. Councilmember Mahowald requested a copy of the financial report be forwarded to him. DRAINAGE DITCH; 1556 ROYAL HILLS DRIVE, STALEKAR Council was referred to a memorandum from the Clerk Administrator dated 5-26-89 regarding a request for tree replacement due to construction of the drainage ditch on Royal Hills Drive. Mrs. Stalekar was present to discuss her request and concerns regarding residents dumping debris and rubbish in the drainage ditch located at the rear of her property. She requested Council consider replacement of the trees that were removed during the construction of the drainage ditch. Clerk Administrator Berger stated he had advised Mrs. Stalekar it was within the contractor's right to remove the trees because of their presence in the City easement; he directed a letter to Mrs. Stalekar advising she could pursue the matter by submitting a formal request to Council for replacement of the trees. Mrs. Stalekar requested the ditch be checked regularly by the city personnel and debris be removed. She also advised her sprinkling system was damaged during construction and requested the city pay for repairs. Engineer Peters recommended the trees not be planted in the easement if Council approves replacement of the trees. He commented the inspector had observed the sprinklers to be located in a different area than the area where construction vehicles accessed the Stalekar property. Councilmember Mahowald expressed concern that the city would be setting a precedent if the trees were replaced in the city easement. Mahowald and Malone did not favor replacement of the trees. Hansen favored replacement of the trees for screening purposes. Peters advised there are approximately seven trees remaining in the easement at the rear of the Stalekar property. Malone moved, seconded by Mahowald, that Council direct the Public Works Supervisor and staff to check on a regular basis and remove debris/rubbish from the drainage ditch located on Royal Hills Drive to keep the ditch free-flowing and further that Council deny the request for replacement of trees at 1556 Royal Hills Drive which were removed during construction of the drainage ditch. Motion carried. (Malone, Mahowald, Growe and Sather voting in favor; Hansen opposed) (4-1)
