<br />July 10, 1989 City Council Minutes, Page Two <br /> <br />. <br /> <br />Planner John Bergly reviewed his July 5 report, <br />indicating that this request by Cardiac <br />Pacemakers, Inc. had been before the <br />Planning Commission on July 5 and the Commission <br />recommended approval of the site plan for Stage I, with PUD Concept <br />approval to be determined in six months, after receipt of approval by Rice <br />Creek Watershed District of the entire plan, completion of a traffic <br />study, completion of an Environmental Assessment Worksheet and resolution <br />of the additional parking space required for the site as requested by the <br />Commission. <br /> <br />CASE 89-10, CPI <br />SITE PLAN APPROVAL <br /> <br />Bergly noted that the site is the former Health Club and that the old <br />tennis court will become a parking lot with access to Fernwood. He noted <br />that minor grading will take place on portions of the site and that a two <br />stage landscape plan is proposed. Most of the landscaping will be <br />interior and additional trees should be placed along Fernwood at the <br />northwest corner of the site. <br /> <br />The applicant had indicated at the Planning Commission meeting that Rice <br />Creek had approved their plan, but it was pointed out that this approval <br />was only for the first stage of development. <br /> <br />. <br /> <br />Malone questioned where the additional parking would come from and felt <br />that the Alpo site, from wbich additional parking space may be negotiated, <br />should request a better and higher use of their land than for parking <br />space for CPl. It was noted that decked parking will be provided if the <br />Alpo property is not available for additional parking. <br /> <br />After further discussion, Malone moved. seconded by Growe, to approve the <br />site plan for Phase I for Cardiac Pacemakers, Inc.,'s site development <br />project. <br /> <br />Ayes: 4 <br />Nays: 0 <br /> <br />Malone also noted that he served on the Planning Commission when this <br />matter originally came before the Commission and he appreciated CPI moving <br />the loading dock, as this was a concern to the Commission previously. <br /> <br />Council acknowledged receipt of an Engineering <br />Services Contract between Maier Stewart and <br />Associates and the City of Arden Hills. City <br />Administrator Berger noted that he had spoken with City Attorney Filla on <br />this contract and that Filla had suggested deleting a sentence on Page 10 <br />of the contract. Terry Maurer of MSA, was agreeable to the deletion of <br />the sentence "THE CITY agrees to hold harmless THE ENGINEER in any case <br />where the CITY'S use of record drawings leads to a civil suit or legal <br />action". <br /> <br />ENGR. SERVICES <br />CONTRACT, M.S.A. <br /> <br />. <br /> <br />Malone moved, seconded by Mahowald, to amend the Professional Engineering <br />Services contract, deleting the "hold harmless" portion on Page 10, as <br />suggested by Attorney Filla. <br />
