<br />. <br /> <br />. <br /> <br />. <br /> <br />Minutes of the Arden Hills Regular Council Meeting, 3-26-90 <br />Page 3 <br /> <br />ORD. 266 (Cont'd) Councillne:mber Hansen supported Mahowald's suggestion to <br />revise the Ordinance amendment and adopt only the two <br />additional days for sale of liquor. <br /> <br />eouncilmembe.r Malone questioned when the state law was changed. <br /> <br />Attorney Filla advised the law allowing extended hours of sale and additional <br />days was passed in 1989. <br /> <br />Malone co:rnrnented he did not foresee this change as having any significant inq;lact; <br />stated the fact that the city permits extended hours does not mean the liquor <br />owners will change their hours. <br />He favored Arden Hills being in conformance with state law. <br /> <br />Mayor Sather agreed with Malone and favored the extension of hours and additional <br />days of sale. <br /> <br />Malone moved, seconded by Sather, to adopt Ordinance No. <br />266, AN ORDINANCE AMENDING CHAPI'ER 3, ARI'ICLE II, DIVISION 1, SECI'ION 3-16 (a) , <br />3-16 (b) , AND REPEALING OJAPI'ER 3, ARI'ICLE II, DIVISION 1, SECI'IONS 3-16(d) OF THE <br />ARDEN HILLS MUNICIPAL CODE REIATING TO THE SALE OF INTOXICATING LIQOORS. Motion <br />failed. (Malone, Sather voting in favor; Hansen and Mahowald opposed) (2-2) <br /> <br />Mahowald moved, seconded by Hansen, to adopt revised <br />Ordinance No. 266, AN ORDINANCE AMENDING CHAPI'ER 3, ARI'ICLE II, DIVISION 1, <br />SECI'ION 3-16(a), 3-16 (b) , AND REPEALING CHAPI'ER 3, ARI'ICLE II, DIVISION 1, <br />SECI'IONS 3-16 (d) OF THE ARDEN HILlS MUNICIPAL cnDE REIATING 'IO THE SALE OF <br />IN'IOXICATING LIQOORS, allowing the sale of liquor on January 1 and July 4, <br />providing several format revisions, and excluding the provision which allows the <br />extended hours of operation on Monday through Thursday. Motion carried <br />unanimously. (4-0) <br /> <br />Councilmembe.r Malone co:rnrnented he remains in favor of allowing businesses to <br />operate within the latitude established by the legislators in such matters and <br />allow them to operate based on the dictates of the market rather than restricting <br />the hours; supported the modification. <br /> <br />Council con=ed to consider the extended hours of sale for intoxicating liquor <br />at a later date in the event the surrounding communities adopt this revision and <br />directed staff to forward a copy of the Ordinance to all affected off-sale liquor <br />establishments . <br /> <br />Council was referred to a letter from four Olaritable <br />Gambling organizations, dated 3-9-90, requesting an <br />amendment to Ordinance #265 by allowing the quarterly <br />reports and payments to the City to be received on the <br />20th day of the month following the end of the quarterly pericxi. <br /> <br />ORD. #267; QRTLY. <br />REEDRr DEADLINE; <br />alAR. GAMBLING <br /> <br />Attorney Filla explained he prepared an Ordinance amendment which would <br />aCCOl1lllK:idate the concerns expressed by the four gambling managers. <br /> <br />Malone moved, seconded by Hansen, to adopt Ordinance No. <br />267, AN ORDINANCE AMENDING CHAPI'ER 4, ARI'ICLE I, DIVISION 5, SECI'ION 5-6 OF THE <br />ARDEN HILlS MUNICIPAL CODE REIATING TO GAMBLING. Motion carried unanimously. <br />(4-0) <br />
