Conformity with the rest of the Subdivision Ordinance: The proposed division or <br /> consolidation shall confoIDl to all requirements of the subdivision Ordinance unless . <br /> given an exemption by the Planning Commission and City Council. <br />5. Fees: All filing fees must be paid. <br />Staff has reviewed these criteria and offers thc following findings offact: <br />1. The submitted survey was prepared by a registered land surveyor and meets City <br /> requirements. <br />2. As noted above, the proposed lots meet all requirements ofthc underlying R-l <br /> Zone. <br />3. The proposed subdivision is unlikely to have any negative affect on the public <br /> welfare. The proposed lots are comparable to and compatible with neighboring lots <br /> within the subdivision. Moreover, if dwcllings are constructed on the lots, they will <br /> contribute to thc local tax base without significantly taxing the existing <br /> infrastructurc. <br />4. The applicant has not met all the applicable requirements of the Subdivision <br /> Ordinance. The Subdivision Ordinance requircs a twelve foot utility easement <br /> centered on fear and other lot lines (Section 1130.05 Subd. 1.). A condition has <br /> been included to resolve this minor issue. All other provisions of the Subdivision <br /> Ordinance are met. The proposed lots havc access to a public road, have adcquate <br /> buildable areas, and meet the requirements of the R-l Zone. <br />5. All required application fees have been paid. This subdivision does result in the <br /> creation of two new residential lot. Under Section 1130.08 of the Subdivision <br /> Ordinance, the park dedication fee would apply to this case. The Recreation and . <br /> Conservation portion (Subd. 2) requires that all subdivisions dedicate a portion of <br /> their land for recreation and conservation purposes or, as deemed comparable value <br /> by thc City Council, pay a park dedication fee in place of a land dcdication. <br /> Although the applicant is not proposing a land dedication, a subdivision resulting in <br /> one new residcntiallot would require a land dedication of six percent, which would <br /> be .14 acres or about 6,194 square feet. Given thc small size of the potential land <br /> dedication and the availability of other ncarby park facilities, a park dcdication fee <br /> may be more appropriate then a land dcdication. In lieu of the land dedication, the <br /> City Council may require the applicant to pay, as an equivalent contribution, an <br /> amount in cash equal to the percentage of the land required to bc dedicated, <br /> multiplied by the fair market value oflhe property at thc time of the final approval <br /> of the subdivision. <br /> Should a fee be accepted in lieu of a land dedication, thc park dedication fee would <br /> he six percent of the land value of the property at thc time of final approval of thc <br /> subdivision. The 2006 market value according to Ramsey County records is <br /> $199,000. This valuc would result in a park dedication fee of$11,940.
