The applicant shall file a minor subdivision with the Ramsey County Recorder and <br /> shall provide the City with a recorded copy within three months ofthe final approval <br /> date, <br /> 2. The applicant shall pay a park dedication fee before filing the subdivision and <br /> consolidation with Ramsey County. The dedication fee shall be determined by the <br /> City Council. <br /> 3. The applicant shall sign a Declaration or Restrictive Covenants that is filed with the <br /> deed on the property. The City Attorney shall review the covenants before the <br /> subdivision is filed with Ramsey County. The Deelaration of Restrictive Covenants <br /> shall inelude the following: <br /> a. The property shall remain subject to the conditions in Planning Case #70-36 <br /> and 05-03. <br /> b. Lots 1, 2, and 3 of the Minor subdivision and Consolidated in Planning Case <br /> #06-004 shall not be further subdivided or reverted back to their originally <br /> platted lots as required by Condition 3 of Planning Case #05-03. <br /> c. The applicant agrees that the conditions of this Covenant and previous <br /> conditions placed on the property from Planning Case #70-36 and 05-03 <br /> cannot be changed or removed without written consent ofthe Arden Hills City <br /> Council. <br /> 4. Any extension of City services for the new lot shall be subject to approval by the City <br /> . Engineer and all associated costs shall be the responsibility ofthe applicant. <br /> 5. The applicant shall comply with applicable provisions of the City Code and related <br /> ordinances. <br /> Chair Sand opened the public hearing at 8:49 p.m. <br /> Chair Sand invited anyone for or against the request to come forward and make <br /> comment. <br /> Raymond Pogue, Represcnting Odd Fellows, stated they were intending on selling the <br /> one lot and he saw the rationale behind combining the lots. He indicated they had a <br /> buyer and he believed this would be good for the neighborhood. He stated they were <br /> proposing to put in a new parking lot as indicated last year. <br /> Chair Sand closed the public hearing at 8:52 p.m. <br /> Commissioner McClung moved, seconded by Commissioner Bezdicek to approve <br /> Planning Case No. 06-004, Odd Fellows, 1174 Edgewater Avenue N; Minor Subdivision <br /> and Consolidation, subject to the five conditions as noted in staffs January 24, 2006 <br /> report with amendment to number 2 to read: The applicant shall pay a park dedication <br /> fee before filing the subdivision with Ramsey County.
