ARDEN HILLS PLANNING COMMISSION - FEBRUARY 1,2006 11 foot parcel. Staff recommended approval of the Special Use Permit Amendment subject . to the following conditions: 1. The applicant shall file a minor subdivision with the Ramsey County Recorder and shall provide the City with a recorded copy within three months ofthe final approval date, 2. The applicant shall pay a park dedication fee before filing the subdivision and consolidation with Ramsey County. The dedication fee shall be determined by the City Council. 3. The applicant shall sign a Declaration or Restrictive Covenants that is filed with the deed on the property. The City Attorney shall review the covenants before the subdivision is filed with Ramsey County. The Deelaration of Restrictive Covenants shall inelude the following: a. The property shall remain subject to the conditions in Planning Case #70-36 and 05-03. b. Lots 1, 2, and 3 of the Minor subdivision and Consolidated in Planning Case #06-004 shall not be further subdivided or reverted back to their originally platted lots as required by Condition 3 of Planning Case #05-03. c. The applicant agrees that the conditions of this Covenant and previous conditions placed on the property from Planning Case #70-36 and 05-03 cannot be changed or removed without written consent ofthe Arden Hills City Council. 4. Any extension of City services for the new lot shall be subject to approval by the City . Engineer and all associated costs shall be the responsibility ofthe applicant. 5. The applicant shall comply with applicable provisions of the City Code and related ordinances. Chair Sand opened the public hearing at 8:49 p.m. Chair Sand invited anyone for or against the request to come forward and make comment. Raymond Pogue, Represcnting Odd Fellows, stated they were intending on selling the one lot and he saw the rationale behind combining the lots. He indicated they had a buyer and he believed this would be good for the neighborhood. He stated they were proposing to put in a new parking lot as indicated last year. Chair Sand closed the public hearing at 8:52 p.m. Commissioner McClung moved, seconded by Commissioner Bezdicek to approve Planning Case No. 06-004, Odd Fellows, 1174 Edgewater Avenue N; Minor Subdivision and Consolidation, subject to the five conditions as noted in staffs January 24, 2006 report with amendment to number 2 to read: The applicant shall pay a park dedication fee before filing the subdivision with Ramsey County. The park dedication fee shall be six percent of the lalld vale of the property at the time of final approval ofthe subdivision . per Arden Hills Ordinance.
