<br /> < lQJ ~~ ~~ <br /> ARDEN HILLS CITY COUNCIL - SEPTEMBER 29. 1997 7 <br /> - <br /> -e D, Gateway Business District (GBD), Sale and Purchasc Agreement/Naegele Outdoor <br /> Advertising, Inc. <br /> . <br /> Mr. Fritsinger explaincd that the City has been negotiating with Naegele Outdoor Advcrtising, <br /> I Inc. for the past several months on the acquisition of three small strips of property. He advised <br /> that the revised agreement is in drati form and rcvisions have been made which are consistent <br /> with recitals the Council has madc. Hc notcd the bcnch handout which staff rccommends to <br /> I addrcss signage. Mr. Fritsinger explained the final draft of the agreement is not yet completed. <br /> Acquisition is approximately $25,258.16 based on the square footagc price, which is consistent <br /> I with othcr purchases that have takcn placc in the district. He explained this property is integral <br /> to the Phase II development being proposed by Welsh Dcvelopment Company, LLC. Mr. <br /> Fritsinger stated there is still work to be done with regard to researching the title. <br /> I Mr. Fritsinger noted Naegclc has two billboards which rest within this propcrty and thc Round <br /> Lake Boulevard public right-of-way. The agreement calls for the removal of those billboards in <br /> I consideration of working with Naegclc to modify the existing billboards on 1-694. Naegele will <br /> be allowcd to place a second panel (facing east) on the eastcrly billboard adjaccnt to 1-694, He <br /> noted that several legal firms have reviewed this and all belicve the reduction in billboards <br /> I reduces the non-conforming use. Naegele also indicated thcy support a collaborative marketing <br /> effort for the remaining 20 acrcs of propcrty for office development. <br /> .e Mr. Fritsinger noted the City has established a good rclationship with Naegele and he supports <br /> consideration of the agreement. However, since staff was not able to present the final agreement <br /> tonight hc is rccommending sevcral additional conditions. Mr. Fritsinger rcad the six additional <br /> I conditions being rccommcndcd as follows: <br /> 1. Recitals being added; <br /> . 2. Addition Section 8( d), indicating considering text to GBD rcgulations as indicated in <br /> correspondence; <br /> 3. Modification of closing date as nccessary to coordinate with the projcct; <br /> I 4. Addition of Section 8( c), posscssion of property will bc when appropriate notices can bc <br /> given; <br /> I 5. Issuance of bonds; and <br /> 6. Award of contract for construction of Fourteenth Street. <br /> . Mayor Probst stated hc understands that Naegcle has expresscd a willingness to relocate the <br /> remaining two billboards, if necessary. Mr. Fritsingcr statcd this is correct and staff plans to <br /> meet on the site to look at how the billboards arc locatcd in relation to 1-694. He stated Naegele <br /> I has been open to other Tequests and working with staff. <br /> Councilmember Malone inquircd rcgarding modification ofthc Zoning Code. Mr. Fritsingcr <br /> I explained it will be inserted that the City will consider an amcndment to the Zoning Code <br /> affccting only the Gatcway District. <br /> .. <br /> I <br /> --..-- <br />
