However, no work should commencc until <br />I certification is received. <br /> Risk <br />I Thc City is at some risk by beginning thc improvements prior to all documents being executed <br /> with Welsh, and Welsh not having closed on all of its properties and financing. The risk is <br />I relatcd to the City completing the improvcments and the project falling apart. If the City Council <br /> assumes that the location of the proposed road and utilitics is correct, rcgardless of the developer, <br /> then the risk is minimal. However, the City should be comfortablc with this assumption. The <br />. additionallanguagc relating to tcrmination clauses is to provide opportunity for the City to <br /> minimize thc amount of cost incurred should Wclsh not proceed with the project. <br />. Recommendation <br /> Tbe Council should consider thc adoption of Resolution #97-47, accepting bid and authorizing <br /> execution of the contract in the matter of the Fourteenth Street NE Road and Utility <br />I Improvemcnt Projcct subjcct to thc following conditions: <br /> . Execution of right of entry and security agreements with Welsh Company; <br />.e . Execution of right of entry agreement with MT Properties/MN Commcrcial Railway <br /> Company; <br /> . Additional language be inserted into thc contract with Lametti which allows the City to <br />. terminate the contract at the completion of clcaring and grubbing and/or completion of <br /> utility improvements; <br /> . Certification of plans and specifications by the City Consulting Enginecr; and <br />. . Execution of right of entry with Naegelc/Morris Communications <br />.
