Variance - Side Yard Setback & Size of Accessorv Structure. Jerome Stradinger. I <br />1426 County Road E <br />A. Request. The applicant is requesting approval of a Variance for a side yard setback and size I <br /> of an accessory structure (Exhibit B). <br />B. Background. The applicant wishes construct an addition to an existing detached garage. I <br /> The existing garage has an existing side yard setback of3'3" and is 396 square feet in area. <br /> The applicants addition would also have a side yard setback of 3'3" and would be 576 square <br /> feet in area. The minimum side yard setback (Section V, F, 8) as required by the Zoning I <br /> Ordinance is ten (l0) feet and the maximum size of an accessory structure (Section VI, A, <br /> 5) is 728 square feet. I <br /> The applicants description of the variance does not include the variance for the size of the <br /> accessory structure. This is due to the fact that when the Staff discussed this application with . <br /> Mr. Stradinger on the telephone, the Staff assumed that the garage was attached to the <br /> principal structure. Therefore, the Staff added the size of accessory structure request when <br /> it received the application. The Staff apologizes to the applicant and the City Council for ~ <br /> any confusion that it may have caused. The existing accessory structure is located in the <br /> side yard of the principal structure. Therefore, the maximum size that it can be is 728 square <br /> feet. If the applicant wished to construct an additional accessory structure in the rear yard I <br /> of this property, then its maximum size would be 562.5 square feet. Therefore, the applicant <br /> could construct a 332 square foot addition (if it met the side yard setback or a variance was <br /> granted) to the existing accessory structure (396 sf + 332 sf= 728 sf) and a 562.5 square foot I <br /> accessory structure in the rear yard of his property by only obtaining a building permit. The <br /> applicant has stated that one larger structure would be more appropriate than two smaller <br /> structures. I <br /> . <br />C. Planning Commission recommendation. The Planning Commission recommends <br /> approval of the variance for a three (3) foot three (3) inch setback variance, and a variance I <br /> for an accessory structure not to exceed 972 square feet in size at 1426 West County Road <br /> E, in Planning Case 97-11, subject to the following condition: . <br /> 1.
