<br /> Staff Recommendation <br /> .. In Planning Case #06-023, Staff recommends approval of the Mastcr & Pinal Planned Unit <br /> Development and Preliminary Plat subject to resolving lhe Hamline Avenue access question and <br /> the following 31 conditions: <br /> L Final Plat. The applicant shall submit an application for a Pinal Plat within six (6) <br /> months following City Couneil approval of the PUD and Preliminary Plat. <br /> 2. PUD Permit. A Planned Unit Development Permit shall be drafted by the City Attorney <br /> and be subject to approval by the City Council prior to the issuance of a Building Permit. <br /> 3. Revised Plans. The applicant shall submit revised plans that are in conformance with the <br /> plan review comments from the City Engineer Pire Marshal, the Building Official prior to <br /> approving the Final Plat, and any other applicable conditions. <br /> 4. Timeline. The applicant's timeline for development shall be as follows: <br /> . Phase l: Pall 2006 - The developer may begin grading, installing utilities, and <br /> construction of storm water improvements. <br /> . Phase 2: Pall/Winter 2006 - The developer may begin construction on units I - 9. <br /> . Phase 2: 2008: Project completed. <br /> Extensions beyond December 31, 200S, shall require an application and be subject to <br /> City Council review and approval. At the time of application for extensions, the City <br /> Council may include such conditions of approval as they determine necessary for <br /> compliance with City Code. <br /> 5. Bvlaws. The bylaws, covenants, deed restrictions, or any other similar documents shall <br /> . be subject to rcview by the City Attorney and shall be submitted prior to filing the Pinal <br /> Plat. <br /> 6. Occupancy. No more than one business shall be permitted to occupy anyone office <br /> condominium within the development. <br /> 7. Uses. Retail, restaurant, fast-food, and residential uses shall not be permitted to occupy <br /> any of the units in the proposed development. Retail uses may be permitted if they are <br /> incidental or accessory to thc primary use. <br /> 8. Outside Storal!e. Outsidc storage shall not be permitted under any circumstanccs. <br /> 9. Landscapinl:! Plan Revisions. The applicant shall submit a revised landscape plan for <br /> review and approval by the City Planner prior to the issuance of building permits that <br /> conforms to the following: <br /> . Additional coniferous trees shall be provided along the west buffer yard of the <br /> development to increase screcning for the trail and residential properties. <br /> . At least 30 percent of the trees shall be in the 3.5" to 4" caliper range and 20 <br /> percent of the trees are in the 4.5" to 5" caliper range.
