<br />i The wetland and the casements reduce the buildable area for proposed Lots I and 2 to the <br />, <br /> areas listed in Seetion l.D ofthis report. To reach the buildable areas listed in Section <br /> . I.D, approximately 834 square feet of the northernmost segment ofthe wetland and two <br /> small segments at thc northeastern part of the wetland are proposed to be filled. On Sheet <br /> C.1 in Attachment 3B.5, the wetland to be filled is located inside the proposed City <br /> easemcnt line. To mitigate the wetland loss, the City will expand the wetland along the <br /> southern edge to compensate for the Joss of wetland on the northern side. Additionally, <br /> approximately five thousand cubic yards of excess fill from the road reeonstmction <br /> project will be used for fill in the wetland and to provide a more stable base outside that <br /> is well above a potential flood area in the buildable area for the future homes on Lots I <br /> and 2. <br /> The Rice Creek Watershed District (RCWD) is the responsible governmental unit for <br /> approving wetland filling and grading. The applicant, with assistance from the City, has <br /> submitted the rcquired documents to the RCWD. Due to the timing ofthe RCWD review <br /> meeting, the decision on the permit was not available in time for the release of this <br /> packet. The applicant will need to submit a copy ofan approved permit from the RCWD <br /> before any wetland filling or grading eould occur. Since the wetland filling is, in part, <br /> related to a City project that involves treating stormwater before it enters Lake Johanna, it <br /> is quite likely that the application to RCWD will be approved. While wctland filling is <br /> usually a cause for concern, this project will help improve the stormwater situation in this <br /> neighborhood and will increase the quality of the water that enters the lake. Although the <br /> wetland will lose some area in its northern edge, the wetland will likely increase in <br /> ovcrall size due to expansion on the southern edge of the wetland. <br /> . <br /> 2. Subdivision Ordinance - Meets requirements <br /> A. Easements. City subdivision regulations require twelve (12) foot wide utility and <br /> drainage easements dedicated to the City along the right.of-way and centered on <br /> common lot lines. The City does not assume responsibility for maintenance of <br /> these areas. The easements will allow acecss if it is ever necessary to enter these <br /> areas. The proposal includes a ten (10) foot wide utility and drainage easement <br /> along the right.of-way and centered on common lot lines, which is two feet short <br /> of the required minimum. <br /> B. Grading, Tree Removal, & Erosion Control.
