She <br />. noted their home had been built by Royal Oaks Realty and she had experienced many <br /> problems with Royal Oaks Realty with them not complying with the City of Arden Hills <br /> requirements and Rice Creek Watershed District requirement. She noted this developer <br /> was not responsive and asked how the City could trust a company that had betrayed them <br /> in the past. <br /> Commissioner Thompson asked if the radius was 25-30 feet would it still be necessary to <br /> move the utility pole. Mr. Hellegers replied staff would need to look at this. <br /> Mr. Clark stated that more than likely the additional space for the radius would create the <br /> need for the driveway to have additional space to the south, outside of the easement. <br /> Commissioner Modesette asked if there was anyway to put in a dedieated turn lane for <br /> the driveway. <br /> Commissioner McClung recommended amendments to the conditions and wanted to add <br /> two additional recommendations. First, with respeet to signage, his eoneern was the <br /> variance for the signage. He stated they should allow a freestanding monument sign on <br /> Highway 96 and it should comply with the sign restrictions. Wall sign age should be <br /> within accordance with the City's sign ordinance standards. He was opposed to a large <br /> sign on the back of units 26-30 and recommended that language be struck from condition <br /> number 9. He noted he would not be in support of a sign variance. He expressed concern <br />. about the trail to the west in that it was only 10 feet from the back of units 1,2 and 3. He <br /> proposed repositioning the buildings to allow a 20- foot setback from where the building <br /> ends to the traiL He believed there would be public safety concerns, as well as drainage <br /> concerns. He recommend a larger than standard radii with a minimum of 30-feet and <br /> allow the applicant to bring forth a proposal that the City would approve prior to the <br /> issuance of a building permit. <br /> Mr. Clark stated it was his understanding the PTRC was asked to look at this and he did <br /> not believe they had made a recommendation to move the buildings, but their concern <br /> was that the integrity of the trail be maintained. <br /> Commissioner Larson asked if the trail way was protected from the drainage plans <br /> submitted. Mr. Brown replied he did not remember that area being a concern, but this <br /> would be something they would look at further and the drainage should not adversely <br /> impact the traiL <br /> Commissioner Thompson asked if they should reeommend some type of lighting on the <br /> trail for the safety of the people walking the traiL Chair Sand noted they needed to <br /> balance the safety for the path users versus lighting issues for the homes by the trail. <br /> Commissioner McClung stated that was the reason he wanted a larger area between the <br /> buildings and the traiL <br />. Mike Black, Royal Oaks Realty, stated they might have some room to make some <br /> adjustments between the buildings to add an additional five feet for the traiL <br />
