<br /> ----- ---- ---- <br /> ~,,~ <br />9, Termination. . <br /> a, Except as otherwise provided in this Lease, this Lease <br /> may be terminated by one party upon sixty (60) days <br /> written notice to the other party as follows: <br /> i. By either party upon a default of any covenant or <br /> term hereof by the other party, which default is <br /> not cured within sixty (60 ) days of receipt of <br /> written notice of default to the other party <br /> (without, however " limiting any other rights of <br /> the parties pursuant to any other provisions <br /> hereof) ; <br /> 1.1.. By Tenant if it is unable to obtain or maintain <br /> any license, permit, or other governmental <br /> approval necessary for the construction and/or <br /> operation of the Antenna Facilities or the Leased <br /> Premises becomes unacceptable under the Tenant's <br /> design or engineering specifications for its <br /> Antenna Facilities or the communication systems to <br /> which the Antenna Facilities belong; <br /> iii. Upon 180 days notice to Tenant By Landlord if the . <br /> Arden Hills City Council decides, in its sole <br /> discretion and for any reason, to redevelop the <br /> Property and/or discontinue use of or remove the <br /> Water Tower; In such event, if a replacement Water <br /> Tower is constructed or the property is <br /> redeveloped in such a way that will accommodate <br /> Tenant's Equipment Building, Antennas and <br /> appurtances, Tenant shall be allowed to construct <br /> such facilities on the Property under <br /> substantially similar terms as this lease. <br /> iv. By Landlord if it determines, in its sole <br /> discretion and for any reason, that the Hater <br /> Tower is structurally unsound for use as a Water <br /> Tower, including but not limited to considerations <br /> of age of the structure, damage or destruction of <br /> all or part of the Hater Tower or the Property <br /> from any source or factors relating to condition <br /> of the Property; or, <br /> 8 . <br /> . <br /> - _.__._------~ <br />
