The owners shall provide a statement of intent of a possible building of a mezzanine. <br /> 5. Parking spaces shall be moved 5 feet from the building and pavement improvements <br /> be made to the easement. <br /> Updates. The applicant has provided additional documentation to support their request <br /> (Exhibit C). The documentation includes: the requested landscape modification; the <br /> requested modification in the sign location; a letter on the proposed use of the building; and <br /> a modification on the south side of the building relocating the parking spaces five (5) feet <br /> from the building. The applicant is proposing that this five foot space be a gravel sidewalk, <br /> it would be more appropriate if this space was a concrete sidewalk, given that there is a door <br /> on this side of the building. <br />3. Case #98-08, Variance - Front Yard Setback (garage) & Street Vacation, City of Arden <br /> Hills (Richard & Janet Shepley), 1550 Oak Avenue <br /> Request. The applicant is requesting approval of a front yard setback variance for an <br /> existing garage (20 feet proposed, when 40 feet is required) and for the vacation of excess <br /> street right-of-way on a single family lot zoned R-l (Exhibit D). <br /> Background. The City reconstructed Oak Avenue in 1996. In preparing the plans and <br />. specifications for this construction the City found out that the existing Oak Avenue was built <br /> outside of the existing right-of-way for Oak Avenue. The City Council determined that the <br /> general alignment of the existing Oak Avenue should be maintained. Therefore, additional <br /> right-of-way from this property owner was required. Additionally as part of this right-of- <br /> way realignment excess right-of-way became available. To which, the City is now proposing <br /> to vacate said excess right-of-way. Lastly, with the new right-of-way the existing garage <br /> for the Shepley's house became non-conforming. Therefore, the City agreed as part of the <br /> right-of-way acquisition to consider the granting of a variance for the applicant's garage. <br /> Deadline for Agency Actions <br /> The City of Arden Hills received the complete application for this request on February 2, <br /> 1998. Pursuant to Milll1esota State Statute the City must act on this request by Friday, April <br /> 3, 1998 (60 days), unless the City provides the petitioner with written reasons for an <br /> additional 60 day review period. The additional review period would extend to Tuesday, <br /> June 2, 1998. The City may with the petitioners consent extend the review period beyond <br /> the Tuesday, June 2,1998, date. <br /> Lastly, if the City denies the petitioners request, "... it must state in writing the reasons for <br /> the denial at the time that it denies the request." <br />. <br />
