The detached garage is currently 24 feet from the west property line. The applicant <br /> wishes to rebuild the existing detached garage at its current size in its current location and attach <br /> it to the existing house with a 588 square foot house addition which would bring the size of the <br /> house up to 1,596 square feet. The rebuilt garage requires the rear yard setback variance and the <br /> house addition requires the side yard setback variance. <br /> Mr. Ringwald reviewed the case and said the lot in question is small in relation to other <br /> properties in the immediate neighborhood (ie., within 350 feet). Also, the effective square <br /> footage is half the normal size of these neighboring lots. <br /> The applicant currently has access through the extension ofFairview Avenue. His garage is 24 <br /> feet from the west property line and he wishes to rebuild that existing garage in its current <br /> location, but also add a 21 foot house addition between the house and the garage. The total <br /> square footage would be 1,600 square feet including the garage. The lot is 50 feet wide and <br /> contains 6,000 square feet and has 35 feet of buildable width. He further described the property <br /> regarding setbacks and said the property owner has provided some exterior drawings. <br /> Chair Erickson said it was clear why the variance is requested, but not clear why the addition <br /> needs to encroach two feet into the setback. Mr. Ringwald said it had to do with an existing <br /> hallway, access into the garage, and how that related to the space. Mr. Kubat presented his <br /> drawings and explained the layout to the Commissioners. <br /> Chair Erickson asked Mr. Ringwald ifhe was comfortable with the efforts made to meet the . <br /> requirements and his response was that the owner had tried his best to minimize the variance. <br /> Mr. Ringwald stated that originally the appl icant proposed a three foot side yard setback and tbat <br /> the applicant had made significant modification to minimize the variance. <br /> Commissioner Sand, in viewing the drawing, referred to the south side yard setback and it was <br /> explained that Mr. Kubat is asking for only a two foot variance. Mr. Ringwald noted that there <br /> are other lots south of this immediate neighborhood whose owners could request variances in the <br /> future. <br /> Mr. Ringwald stated staff recommends approval of Planning Case #98-20, rear yard setback <br /> variance for the attached garage addition (24 feet proposed when 30 feet is required) based on the <br /> "Findings-Rear Yard Setback Variance (attached garagefhouse addition)" section of the staff <br /> report dated July 1, 1998 and the side yard setback variance for the attached garage addition (five <br /> feet proposed when seven feet is required) based on the "Findings-Side Yard Setback Variance <br /> (attached garagefhouse addition)" section of the staffreport dated July 1, 1998, subject to <br /> compliance with the plans and specifications as shown on Exhibit A of the staff report dated <br /> August 5, 1998. If the Planning Commission makes a recommendation on this Planning case, it <br /> would be heard at the Monday, August 31, 1998 regular meeting of the City Council. <br /> . <br /> -~ <br />
