The Planning Commission asked if the City could require <br />businesses that it thought required a license to do so and should this be a requirement in <br />the Ordinance. The Staff would conclude that the City would, assuming reasonable <br />evidence, get a court order to obtain these documents. Whether it was or was not in the <br />Code, if a business decided not to cooperate, the City would still be going to court to get <br />the documents. <br /> <br />9. <br /> <br />Leasing and Ownership Information on License Application. The Planning <br />Cornmission had asked if the leasing and ownership information would be required as <br />part of the license application. If the Planning Commission believes that this would be <br />useful information, then it could be added to Section 3.05, c, of the Ordinance. <br /> <br />Mr. Ringwald stated that the Staff finds the characteristics of Arden Hills are substantially <br />similar to those of the cities cited by the Report when considering the affects of adult uses. The <br />Staff finds, based upon the Report and the studies cited therein, that adult uses may have adverse <br />secondary affects upon certain pre-existing land uses within the City, and that the public health, <br />safety, and general welfare will be promoted if the City adopts regulations regarding adult uses. <br />The adverse secondary affects tend to diminish if adult uses in the City are regulated by <br />locational and licensing requirements. <br /> <br />It is not the intent of the Staff to prohibit adult uses from having a reasonable opportunity to <br />locate within the City; The City's current Zoning Ordinance does not address such adult uses, <br />which have been found by other municipalities to cause similar adverse secondary affects. <br />Specifically, the City Council is concerned that the City's Zoning Ordinance may be inadequate <br />in its scope and in its restrictions to accomplish the purpose for which it was intended. <br /> <br />In addition to the proper zoning classifications of such uses, there is a number of significant <br />planning and land use issues pertaining to the regulation of such uses, including but not limited <br />to: <br /> <br />1. The particular Zoning Districts in which such uses should be allowed as either permitted <br />or conditional uses. <br /> <br />2. The concentration and density of such uses in the City and its neighborhoods. <br /> <br />3. The affects of such uses on other uses in the surrounding area. <br /> <br />Mr. Ringwald advised that, based on the evidence and findings in this and other previously <br />supplied reports related to the effects that Sexually Oriented Businesses would have on the City <br />of Arden Hills, the Staff recommends approval of the Ordinance #311. If the Planning <br />Commission makes a recommendation on this Planning Case, it would be heard at the Monday, <br />February 22,1999, regular meeting of the City Council. <br />
