<br />The new biofilter is proposed to be located to the rear ofthe existing plant. The majority of the
<br />structure will be underground; however, six feet on the west side and two feet on the east side
<br />will be above ground, with a six-foot high chain link fenee along the top of the structure, The
<br />chain link fence is to protect people and animals from entering the biofilter. Staff recommended
<br />the ehain link fenee be open, or earth tone slats be used,
<br />
<br />The proposed structure will meet all setback requirements, A sump pump is proposed for the
<br />bottom of the structure, whieh will generate little noise, Additionally, a fan will be used to raise
<br />the air through the system, which will not be heard outside the property.

<br />The applieant is proposing to add a new tree line in order to better screen the biofilter from the
<br />publie trail during the winter months, Staff recommended that the trees be blue spruce, planted
<br />at a 45 degree angle from each other, 12 feet apart, as shown on Exhibit B,

<br />The grading required will be minimal, Staff recommended that the City Engineer review and
<br />approve the grading plan prior to the building permit being issued. Approval from Riee Creek
<br />Watershed District will also be required.

<br />The applieant is proposing to install a light within the loeation ofthe biofilter to assist with
<br />maintenanee and security, The light would be located at the northwest side ofthe biofilter,
<br />facing southeast, The lighting would meet the Zoning Ordinanee lighting standard. The light ...
<br />would be hooked to a switch and would not be on at all times. The light would only be on during ...
<br />evening maintenance, when neeessary, or during security coneerns. There currently is not any
<br />lighting on this side of the building.

<br />Ms, Randall advised that staffreeommended approval of Planning Case 99-13, Site Plan Review,
<br />to allow for the eonstruetion ofa 50-foot by 57-foot biofilter, conditioned on:

<br />1. Rice Creek Watershed Approval.
<br />2, Exposed foundation be painted earth tone or to match the existing building,
<br />3, Chain link fenee be open, or slats be earth toned.
<br />4, Lighting plan approved by staff prior to installation and the use of the light be
<br />limited to maintenance only,
<br />5, Modif'y the landscape plan as proposed by Staff in Exhibit B.
<br />6, The grading plan be approved by the City Engineer prior to the building permit
<br />being issued,
<br />
<br />Ifthe Planning Commission makes a reeommendation on this Planning Case, it would be heard
<br />at the August 30, 1999, regular meeting of the City Couneil.

<br />Mr, David Petrie, 1293 Wynridge Drive, stated that he lives close to the Friskies plant and
<br />strongly supports the proposed biofilter, He indicated that, at times, the odors from the plant are
<br />bad enough to force the loeal residents inside their homes,
<br />
<br />.

<br />Mr, Petrie stated that, in the past, loeal residents were asked to eall the plant when the odors were
<br />too strong, The problem with this process was that many times the coneems arose at times when
<br />the plant was closed and there was no one available at the plant to make complaints to.
