<br />Memorandum, Code Enforcement Update <br />Page Two <br />October 15, 1999 <br /> <br />. <br /> <br />Mr. Cory, (owner of Perkins restaurant) informed the Fire Inspector that he was going to shut-off <br />his sprinkler system. The Fire Inspector responded by letter on September 22, 1999 that by <br />simply shutting off the sprinkler system he would remain in violation of the fire code that <br />required all sprinkler systems to be maintained in good working condition. <br /> <br />On October 1, 1999, the Fire Inspector received a letter from Mr. Cory's attorney stating that <br />they were going to remove the sprinkler system and that if we had any issues we should contact <br />them innnediately. The Fire Inspector notified Mr. Cory that he could remove the sprinkler <br />system, but advised him that if he were ever to expand his business, he would probably be <br />required to reinstall the sprinkler system. <br /> <br />Staff comments <br />Regarding Perkins restaurant, staff is ofthe opinion that if the restaurant were to be built today, <br />would it be required to have a sprinkler system. The answer is no because the restaurant has less <br />than 300 occupants. <br /> <br />Since the sprinkler system would not be required today, than staff is of the opinion they could <br />remove the sprinkler system and not be in violation of any city code. Staff contacted the state <br />building code for their interpretation and it concurred with city staff. . <br /> <br />. <br />
