(J'-' b~ I <br /> <br />MEMORANDUM OF UNDERSTANDING <br /> <br />This agreement, made and entered this _ day of , 1999, by and between the City <br />of Arden Hills, a Minnesota Municipal Corporation, hereinafter referred to as "City" and <br />the Department of Army, hereinafter referred to as "DOA." <br /> <br />1. PURPOSE <br />On October 5, 1999, President Clinton signed the Defense Authorization Bill. As part of <br />that bill, the Secretary of Army may convey to the City of Arden Hills, Minnesota, all <br />right, title, and interest of the United States in and to a parcel of real property, including <br />improvements thereon, consisting of approximately four (4) usable acres at the Twin <br />Cities Army Ammunition Plant TCAAP), for the purpose of permitting the City to <br />construct a City Hall complex on the parcel. <br /> <br />2. IMPLEMENTATION <br />To implement this bill, the City proposes to enter into a Memorandum of Understanding <br />(MOU) with the Twin Cities Army Ammunition Plant (TCAAP). The intent of this <br />MOU is to define procedural requirements, funding, roles, and responsibilities to <br />successfully execute this land transfer in an expedient manner. <br /> <br />3. <br /> <br />DESCRIPTION OF PROPERTY <br />The exact acreage and legal description of the real property to be conveyed under this <br />agreement shall be determined by surveys satisfactory to the Army. As outlined in the <br />bill, the cost of the survey shall be borne by the City. <br /> <br />4. ENVIRONMENTAL COMPLIANCE <br />The City shall meet the procedural requirements of DOA Regulation 200-1 and DOA <br />Regulation 200-2 for land acquisition. TCAAP and/or its headquarters will review and <br />be the final approval authority on all land transfer documents. <br /> <br />5. ENVIRONMENTAL BASELINE SURVEY, ARMY REGULATION 200-1, <br />CHAPTER 15-6 REAL PROPERTY ACQUlSITON, OUTGRANT AND <br />DISPOSAL TRANSACTIONS <br />It is Army policy to prepare an Environmental Baseline Survey (EBS) to determine tbe <br />environmental condition of properties being considered for acquisition outgrants, and <br />disposals. <br /> <br />Section C, Non-Army-Initiated-Actions <br />For real property transaction initiated by non-Army parties: <br /> <br />a. The non-Army party is responsible for the funding and completion of the EBS. <br />The City shall fund the EBS. <br />
