The building was located in this location because of access to needed <br />hookups and level ground. <br /> <br />e <br /> <br />The State of Minnesota agencies are not required by law to abide by City Ordinance; however, <br />they are choosing to follow City Ordinances. The City has not had any previous applications <br />requested or granted for this property. <br /> <br />The City may determine that a time limitation for a permit for such a temporary building is <br />necessary to assure that the applicant pursues a permanent solution to the situation that required a <br />temporary building. <br /> <br />The applicant expects the temporary structure will not be needed any longer than a two to five <br />year period. Staff would recommend a 2-year time limit with the option to renew beyond that <br />period ifthe new facility has not been constructed by that time. <br /> <br />Accessory structures are required to be 10 feet from the rear property line. However, all <br />structures are to be a minimum of 100 feet from an abutting residential zoning district in the 1-2 <br />zoning distirct. The abutting zoning currently is R-l, single family residential. This, however, <br />this is in conflict with the 1998 Comprehensive Plan update. <br /> <br />Due to the conflict with the Comprehensive Plan, temporary nature of the building, and lack of <br />residential homes in the area, staff recommends the 10-foot accessory structure setback to be <br />sufficient. e <br /> <br />The property is accessed from West County Road I using one entrance. The parking lot <br />circulates in front of all the buildings. The campus includes existing classrooms, administration, <br />gun range, and garages. There are 304 parking spaces for the campus. The parking is more than <br />adequate to serve the existing and proposed temporary building. Currently they are using a <br />portion of the parking area for a basketball and volleyball court. <br /> <br />The property has a split zoning which requires a minimum of a 65 percent landscape lot area for <br />the R-l zoning and 25 percent landscape lot area for the 1-2 zoning. The property consists ofa <br />large wetland area on the west side of the lot. A site plan review has never been completed for <br />this property; however, it does not appear that the temporary structure would decrease the <br />landscape lot area. Staff recommends a site plan review and rezoning be completed prior to the <br />permanent structure being constructed. <br /> <br />Ms. Randall advised that staff recommends approval of Planning Case #00-08, Special Use <br />Permit, subject to the following conditions: <br /> <br />1. Removal of the temporary structure within 2 years or renewal of permit if the new facility has <br />not been constructed by that time. <br />2. Resolution to the Comprehensive Plan and Zoning conflict for this site prior to the <br />construction of the permanent structure. <br />3. Site Plan Review or Special Use Permit completed prior to construction of the permanent e <br />structure. <br /> <br />If the Planning Commission makes a recommendation on this Planning Case, then it would be <br />heard at the Monday, February 14,2000, regular meeting of the City Council. <br />
