<br />e <br /> <br />e <br /> <br />e <br /> <br />ARDEN HILLS PLANNING COMMISSION - FEBRUARY 2, 2000 <br /> <br />DRAFT <br /> <br />5 <br /> <br />Commissioner Baker noted that, with a previous variance approval, the Planning Commission <br />had added a requirement that the variance no longer be applicable if the home were to be <br />destroyed. He asked if a similar requirement should be included with this approval. Ms. Randall <br />stated that this would be possible. She indicated that if the 24-foot variance was granted and the <br />home was destroyed, the applicant could technically request to rebuild the home at the same 24- <br />foot setback. If the Planning Commission did not want this to occur and wanted the home placed <br />back at the 40 foot setback on both sides, a condition could be added that, if the home were at <br />least 50 percent destroyed, the home would have to rebuilt according to the current setback <br />requirements. Chair Erickson stated that this would be a reasonable condition. <br /> <br />Commissioner Baker moved to recommend approval of Planning Case #00-09, corner <br />side yard variance (24 feet proposed, when 40 feet is required) for an addition, based on <br />the "Findings - Corner Side Yard Setback Variance" section of the staff report dated <br />February 2, 2000, with the following condition: <br /> <br />1. Ifthe structure is damaged in excess ofthe building code threshold for damage the <br />variance would no longer be valid. <br /> <br />Commissioner Sand asked if the City Building Code defined the level that a home must meet to <br />be considered destroyed. Ms. Randall stated that there was a level in the Building Code, <br />however, she was not certain what this level was. <br /> <br />Motion seconded by Commissioner Sand. The motion carried unanimously (5-0). <br /> <br />This Planning Case will be reviewed at the Monday, February 14,2000, City Council meeting. <br /> <br />PLANNING CASE #00-10 - HCM ARCHITECTS - RAMSEY COUNTY - TONY <br />SCHMIDT PARK - 3500 LAKE JOHANNA BOULEVARD - SITE PLAN REVIEW - <br />PUBLIC HEARING <br /> <br />Chair Erickson confirmed that the Planning Case was announced in the January 26,2000 <br />publication of the Bulletin and opened the public hearing at 8:03 p.m. <br /> <br />Ms. Randall explained that the applicant was requesting approval of a site plan review (phase 2 <br />construction) for planned upgrades to Tony Schmidt Park. <br /> <br />On February 23, 1998, the City Council approved the special use permit (Concept Approval) for <br />the redevelopment of Tony Schmidt Park. Ramsey County was proposing to redevelop in <br />several phases. On August 31, 1998, the City Council approved Planning Case #98-21, Site Plan <br />(Phase I construction). Last summer Phase I construction was completed. They are now <br />requesting approval for Phase 2 construction. <br /> <br />Tony Schmidt Park contains a unique mixture of active and passive recreational areas as well as <br />natural areas within its boundaries. The active areas are generally at the southern one-third of the <br />park, on either side of Lake Johanna Boulevard. These active areas include the beach and picnic <br />area as well as play areas. The northern two-thirds of the park primarily contains passive <br />
