<br />ARDEN HILLS PLANNING COMMISSION - FEBRUARY 2, 2000 DRAI=f 6 <br /> <br />recreational and natural areas. This area of the park is dominated by a large wetland complex, . <br />which conveys the water from the City's lakes to Rice Creek. <br /> <br />The applicant is proposing six buildings; Picnic Pavilion, Picnic Shelter, Beach Building, <br />Gazebo, and two restroom buildings in various locations throughout the site with this phase. <br /> <br />At the Special Use Permit (Concept Plan) approval, Ramsey County had not progressed far <br />enough along in the design of this park to provide detailed drawings of what the beach house, <br />picnic shelters, and restrooms would look like. <br /> <br />Given that the beach property is within the shoreland area of Lake Johanna, the Shoreland <br />Management section of the City Code (Chapter 20.5) also prescribes the maximum height for <br />structures as 35 feet (Section 20.5-41). The proposed buildings are all one level and do not <br />exceed the 35-foot height requirement. <br /> <br />The Zoning Ordinance in Section V, F, 8, states that the minimum building setback is: 40 feet <br />from the front yard; 30 feet from the rear yard; and 10/25 feet (R-l) and 5/15 feet (R-2) from the <br />side yard. The Zoning Ordinance in Section VI, E, 7, a, states that any public use structure in a <br />residential district shall be at least 75 feet from any residential lot. The City Code (Shoreland <br />Management) states in Section 20.5-41, that the minimum building setback shall be 75 feet from <br />the Ordinary High Watermark (Lake Johanna). All of the proposed buildings meet the setback <br />requirements. The existing buildings will be removed. <br /> <br />The applicant will need Rice Creek Watershed District approval. <br /> <br />e <br /> <br />The subject property is located in the Shoreland Management area, per the Minnesota <br />Department of Natural Resources. The City Code in Chapter 20.5-22, Subpart 12, a, defines <br />Shoreland as land located within 1,000 feet from the ordinary high watermark of lake, pond, or <br />flowage. The beach area, and the adjacent recreation area, is within 1,000 feet of Lake Johanna, <br />a Minnesota Department of Natural Resources protected water. <br /> <br />The City Code in Chapter 20.5-47, (a), (1), permits the selective removal of natural vegetation, <br />provided that sufficient vegetative covers remains to screen cars, dwellings and other structures <br />when viewed from the water. Therefore, if this proposal were to comply with the intent of the <br />Shoreland Management regulations, then the maintenance of a vegetative buffer, where practical, <br />is required between this use and Lake Johanna. <br /> <br />The City Code in Chapter 20.5-47, (b), allows for grading and excavation in shoreland areas by <br />permit. <br /> <br />These permits will need to be completed prior to the building permit being issued. <br /> <br />Ms. Randall noted that the reason for the unusual design of the picnic pavilion was to allow for <br />the pavilion to be used by more than one group at a time. Additionally, the proposed bathrooms . <br />meet handicap accessibility requirements. <br /> <br />Ms. Randall advised that Staff recommends approval of Planning Case #00-10, Site Plan <br />Review, subject to the following conditions: <br />
