<br />D. Local Obligations <br /> <br />Under federal, state and regional law , the City of Arden Hills must fulfill several obligations connected with <br />planning for the reuse ofTCAAP. The applicable laws are discussed below and the City's role is briefly described <br />for each. <br /> <br />1. Federal Excess Property Regulations <br /> <br />Unlike many of the military installations closing nationwide, TCAAP is not considered to be a "base". Therefore, it <br />is not being closed under the procedures prescribed in the Base Realigmnent and Closure ACT (BRAe) as amended. <br />The BRAC legislation set up a new procedure for disposal of military property by requiring that the service branch <br />involved in the property disposal work directly with the local community to develop a locally acceptable reuse plan <br />for the site. Other provisions of this legislation give primacy to this local plan and give the local community greater <br />control over sale and development of the property. <br /> <br />TCAAP is slated to pass through the more traditional federal property disposal procedures that pass the property <br />from the service branch to the General Services Administration (GSA) and eventually to public sale. GSA disposals <br />follow a rigid path from the service branch to the remainder of the Department of Defense, then through the federal <br />government, then to lower units of government and [mally to the general public. These procedures are summarized <br />here. The full GSA regulations appear in the Appendix to this report. <br /> <br />TCAAP is currently owned by the U.S. Army. The Army has stated its intention to declare TCAAP as "excess <br />property". Excess property is any property under the ownership and control of a federal agency that is not required <br />to carry out the mission of that agency. <br /> <br />Once the Army formally determines that TCAAP is excess property, it will notify the U.S. Army Corps of <br />Engineers. The Corps will conduct an inquiry within the Department of Defense (DaD) to determine whether any <br />other service branch division has a use for all or part of TCAAP. <br /> <br />Any portion of TCAAP that is not retained by a DaD entity will be turned over to the GSA, as the landlord for the <br />Federal Government, to determine whether any other Federal agency has a need for TCAAP or whether it is surplus <br />property. <br /> <br />The GSA will send a notice to all federal agencies with land-holding missions, advising them of the availability of <br />this excess property. These agencies have 30 days to communicate their interest in TCAAP to GSA. If a tentative <br />need is expressed, the requesting agency may bave an additional 30 days to determine whether the need is fIrm. <br /> <br />If no agency expresses an interest in acquiring TCAAP within this 60-day period, the property will be declared <br />"surplus" by the GSA. It can then be disposed of outside the federal government. <br /> <br />The GSA must next communicate the availability ofTCAAP to those federal agencies statutorily authorized to <br />claim property for a state or local govemment or for a non-profit entity. These agencies include: <br />Department of Education -- educational purposes; <br />Department of Health and Human Services -- public health, shelters for homeless <br />Department of the Interior -- historic monuments, wildlife conservation, Indian affairs <br />Department of TranspOrlation -- higbways, airports, transit facilities <br />Department of Justice -- correctional facilities <br /> <br />Federal agencies, on behalf of their authorized nominees, will have 20 days to express an interest in TCAAP to the <br />GSA.
